Regulation 1998

Maritime Services Act 1935
His Excellency the Governor, with the advice of the Executive Council, has
made the following Regulation under the Maritime Services Act 1935. Kim Yeadon
Minister for PortsExplanatory note The object of this Regulation is to increase the fees set out in the
Management of Waters and Waterside Lands Regulations—N.S.W for:
(a) occupation licences for boatsheds or similar business activities, and (b) private occupation licences (that is, licences other than for boatsheds or similar business activities), and (c) applications for exemptions. Regulations 35A, 35B, 36A and 36B of the Management of Waters and waterside Lands Regulations—N.S.W provide that persons who were first issued with occupation licences before 3 I July 1992 pay lower licence fees than persons who were issued their licences after 31 July 1992. This Regulation removes this disparity and institutes a single scheme of fees for occupation licence holders.
This Regulation is made under the Maritime Services Act 1935, including section 38 (the general regulation-making power), in particular section 38

1 Name of Regulation
This Regulation is the Management of Waters and Waterside Lands Amendment (Fees) Regulation 1998.
2 Commencement
This Regulation commences on 31 March 1998.
3 Amendment of Management of Waters and Waterside Lands Regulations—N.S.W.
The Management of Waters and Waterside Lands Regulations- N.S.W. are amended as set out i n Schedule 1 .

(Clause 3)
[ 1 ] Regulations 35A and 35B
Omit the Regulations.
Insert instead:
35A Fee for occupation licence for boatshed or similar business activity
(1) The annual fee payable for an occupation licence in the
Sydney Harbour locality or the Pittwater locality is:
(a)
in respect of a class A licence—$186 for each mooring site, or
(b)
in respect of a class B, C, D, E, F, G, H, I, J or K licence—$311 for each mooring site.
(2) The annual fee payable for an occupation licence in a
locality other than a locality referred to in clause ( l) is:
(a)
in respect of a class A licence—$125 for each mooring site. or
(b) in respect of a class B, C, D, E, F, G, M, I, J or K
licence-$248 for each mooring site.
[2] Regulations 36A and 36B
Omit the Regulations.
Insert instead:
36A Fee for occupation licence—other than for boatshed or similar business activity
(1)
The annual fee payable for an occupation licence in the Sydney Harbour (Western) locality or the Pittwater locality is:
(a) in respect of a class 1 licence—$204, or

(b)
in respect of a class 2 licence-$204, plus an additional $69 for each metre or part of a metre by which the length of the vessel exceeds 7m, or
(c)
in respect of a class 3 licence-$477, plus an additional $136 for each metre or part of a metre by which the length of the vessel exceeds 11m.
(2) The annual fee payable for an occupation licence in the
Sydney Harbour (Eastern) locality is:
(a) in respect of a class 1 licence—$255, or (b)
in respect of a class 2 licence—$255, plus an additional $85 for each metre or part of a metre by which the length of the vessel exceeds 7m, or
(c)
in respect of a class 3 licence—$596, plus an additional $169 for each metre or part of a metre by which the length of the vessel exceeds 11m.
(3)
The annual fee payable for an occupation licence in a locality other than a locality referred to in clauses (1) or (2) is:
(a) in respect of a class 1 licence—$136, or (b) in respect of a class 2 licence—$136, plus an additional $29 for each metre or part of a metre by
which the length of the vessel exceeds 7m, or
( c ) in respect of a class 3 licence—$271, plus an additional $54 for each metre or part of a metre by which the length of the vessel exceeds 11m.
[3] Regulation 63J Applications for exemptions
Omit “$93” wherever occurring from Regulation 63J.
Insert instead “$95”.
