Marine Safety Legislation Amendment

(Fees) Regulation 2012

Marine Safety Act 1998

His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Marine Safety Act 1998.

Explanatory note
The object of this Regulation is to amend the Marine Safety (Commercial Vessels) Regulation 2010 and Marine Safety (General) Regulation 2009 to adjust certain fees payable under the Marine Safety Act 1998.
The fee increases are generally in line with movements in the Consumer Price Index (CPI).

Under the Marine Safety (General) Regulation 2009:

(a) the fees for the 3-year personal watercraft driving licences and boat driving licences are being increased by the CPI, but the fees for the 5-year personal watercraft driving licences and boat driving licences are being decreased to correct the discount gap between the 3-year and 5-year licences, and
(b) the fee ($19) for the replacement of a marine safety licence or vessel registration label is not being increased.

This Regulation also amends the Marine Safety (Commercial Vessels) Regulation 2010 to correct a misdescription in respect of the fee for the issue of a new Certificate of Competency for a Coxswain or a Master of Vehicular Ferry in Chains.

This Regulation is made under the Marine Safety Act 1998, including sections 37 (2) (k) and

137 (the general regulation-making power).

Regulation 2012.

2      Commencement

This Regulation commences on 1 October 2012 and is required to be published on the NSW legislation website.
