Marine Safety Legislation Amendment

(Fees) Regulation 2011

Marine Safety Act 1998

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Marine Safety Act 1998.

Explanatory note
The object of this Regulation is to amend the Marine Safety (Commercial Vessels) Regulation 2010 and Marine Safety (General) Regulation 2009 to adjust certain fees payable under the Marine Safety Act 1998.
The fee decreases are consequent on a Division 81 determination under the A New Tax System (Goods and Services Tax) Act 1999 of the Commonwealth that excluded those fees from the scope of the goods and services tax base. The fee increases are generally in line with movements in the Consumer Price Index. Certain other fees remain unaltered.
This Regulation is made under the Marine Safety Act 1998, including sections 37 (2) (k) and

137 (the general regulation-making power) and, in particular, section 137 (1A).

1      Name of Regulation

This Regulation is the Marine Safety Legislation Amendment (Fees)
Regulation 2011.

2      Commencement

This Regulation commences on 1 October 2011 and is required to be published on the NSW legislation website.
