Marine Safety (General) Amendment

(Exemptions Relating to Safety Equipment

and Facilities) Regulation 2013

under the

Marine Safety Act 1998

Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Marine Safety Act 1998.

Explanatory note
The object of this Regulation is to modify existing exemptions from those provisions of the Marine Safety (General) Regulation 2009 that require certain safety equipment to be carried on recreational vessels and lifejackets to be worn by those on vessels and that regulate the construction of hatches and exterior doors. This Regulation:

(a) provides that surf row boats are no longer exempt from those provisions, and
(b) extends the current exemption for vessels used in connection with lifesaving or surf rescue by lifesaving clubs affiliated with the Royal Life Saving Society—Australia or Surf Life Saving New South Wales, so that:
(i) all vessels used in connection with surf rescues, competition or training conducted by such clubs will be exempt, and
(ii) vessels used in connection with such activities conducted by clubs affiliated with Surf Life Saving Australia are also exempt, so that interstate clubs may rely on the exemption when training or competing in New South Wales, and
(c) updates the name of an organisation.

This Regulation is made under the Marine Safety Act 1998, including sections 67 (Regulation of marine safety equipment or facilities) and 137 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Marine Safety (General) Amendment (Exemptions Relating to
Safety Equipment and Facilities) Regulation 2013.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Marine Safety (General) Regulation 2009

(1) Clauses 29 (4), 33 (4) (a), 61 (3) and 72 (3)

Omit “Surf Life Saving New South Wales Inc” wherever occurring.

Insert instead “Surf Life Saving New South Wales”.

(2) Clause 82 Vessels exempt from certain requirements of Part
Omit clause 82 (1) (b) and (c). Insert instead:
(b) a vessel (other than a personal watercraft) used in connection with lifesaving, surf rescues, a competition or training conducted by a club affiliated with:
(i) the Royal Life Saving Society—Australia, or
(ii) Surf Life Saving Australia Limited, or
(iii) Surf Life Saving New South Wales,
