Marine Safety Amendment Regulations 2021

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to make consequential amendments to the Marine Safety Regulations 2012 arising from the making of the Marine Safety (Fees) Regulations 2021.

2Authorising provisions

These Regulations are made under sections 309, 310 and 312 of the Marine Safety Act 2010.

3Commencement

These Regulations come into operation on 7 July 2021.

4Principal Regulations

In these Regulations, the Marine Safety Regulations 2012[1] are called the Principal Regulations.

5Application for registration of a vessel

For regulation 11(2)(e) of the Principal Regulations substitute

"(e)be accompanied by the applicable fee for boating facilities and safety education.

Note

See regulation 5 of the Marine Safety (Fees) Regulations 2021 for the fee payable for boating facilities and safety education.".

6Renewal of registration of a vessel

(1)In regulation 14(1) of the Principal Regulations, for "the fee for boating facilities and safety education prescribed in regulation 136" substitute "the applicable fee for boating facilities and safety education".

(2)At the foot of regulation 14(1) of the Principal Regulations insert

"Note

See regulation 5 of the Marine Safety (Fees) Regulations 2021 for the fee payable for boating facilities and safety education.".

7Transfer of registration of a vessel—obligations of person acquiring vessel

For regulation 18(c) of the Principal Regulations substitute

"(c)pay the applicable fee for acquiring a registered vessel.

Note

See regulation 6 of the Marine Safety (Fees) Regulations 2021 for the fee payable for acquiring a registered vessel.".

8Special identification plates

For regulation 25(2)(b) of the Principal Regulations substitute

"(b)accompanied by the applicable fee for the issue of a special identification plate in respect of a vessel.

Note

See regulation 7 of the Marine Safety (Fees) Regulations 2021 for the fee payable for the issue of a special identification plate.".

9Application for a marine licence or marine licence endorsement

For regulation 33(1)(e) of the Principal Regulations substitute

"(e)the applicable fee or fees for the grant or endorsement of a marine licence or restricted marine licence.

Note

See regulation 8 of the Marine Safety (Fees) Regulations 2021 for the fee or fees payable for the grant or endorsement of a marine licence or restricted marine licence.".

10Renewal of marine licence

For regulation 38(1)(c) of the Principal Regulations substitute

"(c)the applicable fee for the renewal of a marine licence.

Note

See regulation 8 of the Marine Safety (Fees) Regulations 2021 for the fee payable for the renewal of a marine licence.".

11Issue of replacement marine licence document

(1)In regulation 49(1) of the Principal Regulations, for "fee specified under regulation 140" substitute "applicable fee".

(2)At the foot of regulation 49(1) of the Principal Regulations insert

"Note

See regulation 9 of the Marine Safety (Fees) Regulations 2021 for the fee payable for the issue of a replacement marine licence.".

12Records

(1)In regulation 52(2) of the Principal Regulations, for "fee specified under regulation 141" substitute "applicable fee".

(2)At the foot of regulation 52(2) of the Principal Regulations insert

"Note

See regulation 10 of the Marine Safety (Fees) Regulations 2021 for the fee payable to request a search of the records of marine licences and to obtain a certificate.".

13Part 15 revoked

Part 15 of the Principal Regulations is revoked.

Fee Units

These Regulations provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004.

The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit.

The value of a fee unit for the financial year commencing 1 July 2021 is $15.03. The amount of the calculated fee may be rounded to the nearest 10 cents.

The value of a fee unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004. The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
