Marine Safety Amendment (Marine

Pollution) Regulation 2006

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Marine Safety Act 1998.

Explanatory note
Schedule 1 to the Marine Safety Regulation 2003 prescribes the offences under the Marine Pollution Regulation 2001 in respect of which penalty notices may be issued, and prescribes the amount of penalty for the offence if the offence is dealt with by way of a penalty notice. The Marine Pollution Regulation 2001 is repealed on 1 September 2006 by section 10 (2) of the Subordinate Legislation Act 1989 and is replaced by the Marine Pollution Regulation 2006.
The object of this Regulation is to repeal and remake Schedule 1 to the Marine Safety Regulation 2003 in view of the repeal and replacement of the Marine Pollution Regulation 2001.

This Regulation is made under the Marine Safety Act 1998, including sections 126 (Penalty notices) and 137 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Marine Safety Amendment (Marine Pollution)
Regulation 2006.

2      Commencement

This Regulation commences on 1 September 2006.

3 Amendment of Marine Safety Regulation 2003

The Marine Safety Regulation 2003 is amended as set out in Schedule 1.
