Her Excellency the Governor, with the advice of the Executive Council, has made the following

Explanatory note

The object of this Regulation is to allow Roads and Maritime Services to exempt any class of persons or vessels from the provisions of the Marine Safety Regulation 2016 by publishing an order in the Gazette instead of on the NSW legislation website, as is currently the case.

This Regulation is made under the Marine Safety Act 1998, including sections 137 (the general regulation-making power) and 139.

1      Name of Regulation

This Regulation is the Marine Safety Amendment (Exemptions) Regulation 2019.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Marine Safety Regulation 2016

Clause 140 Exemptions by RMS

Omit “on the NSW legislation website” from clause 140 (3) (b).

Insert instead “in the Gazette”.
