s1 2 s4 Marine Parks (Cairns) Amendment (No. 1) No. 295, 1999 ˙ Short title 1. This zoning plan may be cited as the Marine Parks (Cairns) Amendment Zoning Plan (No. 1) 1999 . ˙ Zoning plan amended 2. This zoning plan amends the zoning plan for Cairns Marine Park. 1 ˙ Replacement of s 1 (Application of zoning plan) 3. Section 1— omit, insert — ˙ ‘ Short title ‘ 1. This zoning plan may be cited as the Marine Parks (Cairns) ZoningPlan 1992 . ˙ ‘ Application of zoning plan ‘ 1A. This zoning plan applies to the Cairns Marine Park.’. ˙ Amendment of s 2 (Interpretation) 4.(1) Section 2(2)(c), ‘where’— omit, insert— ‘if’. (2) Section 2(2)(c), ‘insects’— omit, insert— ‘intersects’. 1 The zoning plan was approved by the Governor in Council by the Marine Parks (Cairns Zoning Plan) Order 1992 , section 2.

s5 3 s6 Marine Parks (Cairns) Amendment (No. 1) No. 295, 1999 ˙ Amendment of s 21 (Designated Areas) 5. Section 21(1)— insert — ‘(f) restricted access areas.’. ˙ Insertion of new pt 4, div 6A 6. After division 6— insert — ‘ Division 6A—Restricted access areas ˙ ‘ Objective ‘ 30A. The objective of a restricted access area is to protect animals and marine products in the marine park from human intrusion. ˙ ‘ Entry and use ‘ 30B. A person must not enter or use a restricted access area other than under schedule 3A. 2 ˙ ‘ Chief executive to erect signs ‘ 30C. The chief executive must, on or near each restricted access area, erect signs stating— (a) the restrictions and conditions applying to the entry or use of the area; and (b) the penalty for failing to comply with the restrictions or conditions.’. 2 The Marine Parks Regulation 1990 , section 8A sets out the penalty for unauthorised entry or use of a designated area.

s7 4 s8 Marine Parks (Cairns) Amendment (No. 1) No. 295, 1999 ˙ Amendment of sch 3 (Designated area boundaries) 7. Schedule 3— insert — ‘ Restricted access area for Michaelmas Cay ‘ 6. The restricted access area for Michaelmas Cay consists of the part of the cay between the high and low water marks.’. ˙ Insertion of new sch 3A 8. After schedule 3— insert — ‘ SCHEDULE 3A ‘ ENTRY AND USE OF RESTRICTED ACCESS AREAS section 30B ˙ ‘ Michaelmas Cay ‘ 1.(1) Subject to subsection (4), a person may enter or use only the part of the restricted access area for Michaelmas Cay bounded by a rope and extending from either end of the rope down to the low water mark (the “accessible area” ). ‘ (2) The person may enter or use the accessible area— (a) for a purpose for which the person may enter or use the National Park Zone; 3 and (b) only between 9.30 a.m. and 3.00 p.m. ‘ (3) The person must not, in the accessible area, carry out an activity, or use the area in a way, that may disturb a bird on Michaelmas Cay. 3 For the purposes for which a person may enter or use the National Park Zone, see section 16 (Entry and use) of this zoning plan.

s8 5 s8 Marine Parks (Cairns) Amendment (No. 1) No. 295, 1999 Examples of ‘activity’ for subsection (3)— 1. Flying a kite. 2. Using a beach umbrella. 3. Using a horn or klaxon. ‘ (4) A person may, with the chief executive’s written permission, enter or use the restricted access area to carry out scientific research relating to the conservation of Michaelmas Cay.’.
