2 Marine Parks Amendment (No. 2) No. 195, 1993 ˙ Short title 1. This regulation may be cited as the Marine Parks Amendment Regulation (No. 2) 1993 . ˙ Amended regulation 2. The MarineParksRegulation1990 is amended as set out in this regulation. ˙ Replacement of s.5 (Fees) 3. Section 5— omit, insert— ˙ ‘Fees ‘5.(1) The fees payable for— (a) assessment of an application for permission to carry out an activity in a marine park for the purpose of tourism are set out in Schedule 1; and (b) assessment of an application for continuation of a relevant permission are set out in Schedule 2; and (c) permission to carry out an activity in a marine park that involves the operation of a commercial whale watching program are set out in Schedule 3. ‘(2) The fee payable under Schedule 1 or 2 for an activity that is mentioned in more than 1 item in the Schedule is the highest of the fees payable for the activity. ’. ˙ Amendment of s.9 (Application for relevant permission) 4.(1) Section 9(4)— omit, insert— ‘(4) The Director may request an applicant for a relevant permission to give the Director further written particulars (including an environmental
3 Marine Parks Amendment (No. 2) No. 195, 1993 impact statement) as the Director may reasonably require to properly consider the application. ‘(4A) The particulars requested under subsection (4) are to be given within 60 days of the request, or such longer period as the Director allows. ‘(4B) If a fee is payable under section 5(1)(a) or (b), the Director must, by written notice, ask the applicant to pay the fee within 60 days of the giving of the notice, or such longer period as the Director allows. ‘(4C) If the applicant fails to comply with subsection (4), (4A) or (4B), the application lapses. ’. (2) Section 9(6)— omit, insert— ‘(6) If the Director considers that the grant of an application for a relevant permission may restrict the reasonable use of a part of the marine park by persons other than the applicant, the Director may give the applicant a written notice that requires the applicant, within a specified period, to give public notice of the application. ‘(6A) The public notice must— (a) set out information the Director may reasonably require; and (b) invite interested persons to make written submissions to the Director, in relation to the application, at an address specified in the notice and within a specified period (not less than 30 days). ‘(6B) In subsections (6) and (6A)— “public notice” means a notice published on 2 days in a 14 day period in— (a) the Gazette; and (b) a newspaper that circulates throughout the State; and (c) a local newspaper that circulates in the part of the State that is adjacent to the part of the marine park to which the application relates. ’. (3) Section 9(7)— omit ‘ subregulation (6)(a) ’, insert ‘ subsection (6) ’.
