AN ACT to amend the Marine Navigational Aids Act,

1973.

[Assented to 28th November, 1977.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Marine Navi-

(2) In this Act the Marine Navigational Aids Act, No 27 of

1973.

1973 is referred to as the principal Act.

(3) The principal Act as amended by this Act may

be cited as the Marine Navigational Aids Act, 1973-

No. 66.]

Section 3

amended.

2. Section 3 of the principal Act is amended

(a)

as to subsection (1), by inserting after paragraph (a) a new paragraph as follows-

(aa) may enter into an agreement with any person who has established or who proposes to establish a naviga- tional aid providing for the transfer from that person of the control of that aid; ; and

(b)

by adding a further subsection as follows

(3) Where the Department or a Port Authority enters into an agreement pur- suant to paragraph (aa) of subsection (1) of this section

(a)

any navigational aid to which the agreement applies shall be deemed to have been or to be established under this Act; and

(b)

provision shall be made in the agreement for the payment from time to time of the expense in- curred in the exercise of the powers conferred by paragraphs (b), (c) and (d) of that subsec- tion. .
