Marine (Infringements Amendments) Regulations 2008

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Marine Regulations 1999 to—

(a)prescribe a marine infringement offence for operating a vessel on coastal waters without an approved emergency position indicating radio beacon;

(b)amend the description of the offence of anchoring a vessel in a navigation channel or other specified area;

(c)revoke regulations made redundant by the enactment of the Infringements Act 2006.

2Authorising provision

These Regulations are made under section 105 of the Marine Act 1988.

3Commencement

(1)These Regulations, except regulation 6, come into operation on the day on which they are made.

(2)Regulation 6 comes into operation on 1 February 2009.

4Schedule 13 amended

(1)In the Table in Schedule 13 to the Marine Regulations 1999[1] after the heading "General Offences" before the item relating to Code 2341 insert

"2340 Operate vessel on coastal waters more than 2 nautical miles from the shore without approved emergency position indicating radio beacon MR r. 207 1·25 penalty units".

(2)In the Table in Schedule 13 to the Marine Regulations 1999, in Column 2 of the item relating to Code 2317, for "Anchor vessel in navigation channel or the area of State waters which impedes or may impede any other vessel in contravention of the Notice" substitute "Anchor vessel in a channel that is marked with beacons or buoys in contravention of the Notice".

5Redundant regulations and schedules

(1)In the heading to Part 9 of the Marine Regulations 1999 for "INFRINGEMENT NOTICES" substitute "INFRINGEMENTS".

(2)Regulations 901, 902, 904 and 905 of the Marine Regulations 1999 are revoked.

(3)In regulation 903 of the Marine Regulations 1999 omit "61(3) or".

(4)Schedules 14 and 15 to the Marine Regulations 1999 are revoked.

6Item in Schedule 13 revoked

In the Table in Schedule 13 to the Marine Regulations 1999 after the heading "General Offences" the item relating to Code 2340 is revoked.
