1Objective

The objective of these Regulations is to prescribe the information to be included in the form for the payment of fees for services in relation to domestic commercial vessels for the purposes of the Marine (Domestic Commercial Vessel National Law Application) Act 2013.

2Authorising provision

These Regulations are made under section 21 of the Marine (Domestic Commercial Vessel National Law Application) Act 2013.

3Definitions

In these Regulations—

National Regulator has the same meaning as in the Marine (Domestic Commercial Vessel National Law Application) Act 2013;

the Act means the Marine (Domestic Commercial Vessel National Law Application) Act 2013; and

the Director, Transport Safety has the same meaning as in the Transport Integration Act 2010.

4Prescribed information

For the purposes of section 21(1)(a) of the Act, a form for the payment of a fee referred to in section 14 of the Act must include—

(a)a statement that "This fee is charged in relation to a service provided under the Marine Safety (Domestic Commercial Vessel) National Law of the Commonwealth by the Director, Transport Safety as a delegate of the National Regulator (the Australian Maritime Safety Authority) toward the cost of the national system for domestic commercial vessels"; and

(b)sufficient information to identify the nature of the service provided; and

(c)details of the entity to which payment is to be made; and

(d)a statement that payment is to be made to that entity for services provided by the Director, Transport Safety as a delegate of the National Regulator (the Australian Maritime Safety Authority).

Note

The fees to which the forms relate are set out in the Schedule to the Marine (Domestic Commercial Vessel National Law Application) Act 2013.

1.     General Information

The Marine (Domestic Commercial Vessel National Law Application) (Prescribed Information on Forms) Regulations 2013, S.R. No. 100/2013 were made on 30 July 2013 by the Governor in Council under section 21 of the Marine (Domestic Commercial Vessel National Law Application) Act 2013, No. 36/2013 and came into operation on 30 July 2013.

The Marine (Domestic Commercial Vessel National Law Application) (Prescribed Information on Forms) Regulations 2013 will sunset 10 years after the day of making on 30 July 2023 (see section 5 of the Subordinate Legislation Act 1994).

There are no amendments made to the Marine (Domestic Commercial Vessel National Law Application) (Prescribed Information on Forms) Regulations 2013 by statutory rules, subordinate instruments and Acts.
