Marine and Safety (Collision) Regulations 2017

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Marine and Safety Authority Act 1997 .22 May 2017

1Short titleThese regulations may be cited as the Marine and Safety (Collision) Regulations 2017 . 2CommencementThese regulations take effect on 4 July 2017. 3InterpretationIn these regulations – International Regulations means the International Regulations for Preventing Collisions at Sea 1972 issued by the International Maritime Organization, as amended from time to time. 4Adoption of International RegulationsThe International Regulations, together with any notes included in the International Regulations, are adopted as regulations for the purposes of the Marine and Safety Authority Act 1997 . 5Offence to contravene International RegulationsA person must not contravene a provision of the International Regulations as adopted under regulation 4 .

Penalty:  Fine not exceeding 50 penalty units.

6Revocation of distress signals (1)  This regulation applies if the master of a vessel transmits, or causes or allows the transmission of, an international distress signal from the vessel but later determines that the vessel is no longer in need of assistance. (2)  As soon as practicable after determining that the vessel is no longer in need of assistance, the master of the vessel must transmit a message revoking the international distress signal or cause such a message to be transmitted.

Penalty:  Fine not exceeding 50 penalty units.

(3)  For the purposes of subregulation (2) , a message revoking an international distress signal is not taken to have been transmitted until the message has been acknowledged by a coast station. (4)  In this regulation – international distress signal means a distress signal prescribed in Annex IV of the International Regulations; transmit means transmit by means of a ship radio.

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations –

(a) adopt the International Regulations for Preventing Collisions at Sea 1972 as regulations under the Marine and Safety Authority Act 1997 ; and (b) provide for the revocation of international distress signals; and (c) are made consequentially on the repeal of the Marine and Safety (Collision) Regulations 2007 under section 11 of the Subordinate Legislation Act 1992 .
