HIS HONOUR: There are no appearances in respect of this 1
matter. which is appeal number 72 of 2001, the appellant Dean
Mannix, and the respondent Robert Meissner.
There is correspondence on the file. Firstly, a letter dated

7 July 2007, under the hand of Mr Mannix, which states,

relevantly:

"I confirm my consent to having this matter struck out

with no order as to costs."

And a subsequent letter, dated 16 July 2007, from the Department of Tourism, Fair Trading and Wine Industry

Development under the hand of Robert Vize, principal legal

officer, which states:

"I refer to the appellant's correspondence 7 July 2007,
in which he advises that he seeks to have the appeal
struck out with no order as to costs. The respondent

consents to an order being made in those terms."

In the circumstances, there being no appearance in person by

either the appellant or respondent, and those appearances are 40
excused, I order that the appeal be struck out and I order no
order as to costs.
