And a subsequent letter, dated 16 July 2007, from the Department of Tourism, Fair Trading and Wine Industry
Development under the hand of Robert Vize, principal legal
officer, which states:

"I refer to the appellant's correspondence 7 July 2007,
in which he advises that he seeks to have the appeal
struck out with no order as to costs. The respondentconsents to an order being made in those terms."
In the circumstances, there being no appearance in person by
