Act No. 1(3, 1911.

An Act to sanction the carrying out of certain harbour works at Manning River; and for purposes consequent thereupon or incidental thereto. [15th November, 1911.]

W H E R E A S , in accordance with the provisions of the Public: Works Act, 1900, the Legislative Assembly did, by resolution,

declare that it was expedient to carry out a certain work, namely, the completion of the harbour works at the entrance to the Manning River : And whereas, on the passing of the said resolution, a statu- tory duty Avas by the said Act imposed on the Secretary for Public Works to introduce a Bill into the said Assembly to sanction the carrying out of the said work : P>e it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1 . This Act may be cited as the " Manning Liver Harbour;

Supply, and deposited in the public office of the said Secretary.

Works Act, 1911."
2 . The carrying out of the works, more particularly described' in the Schedule to this Act, is hereby sanctioned, and the Secretary for Public Works, or the member of the Executive Council for the time being performing the duties of the said Secretary, is hereby authorised to undertake and carry out the said works, subject to the provisions of this Act, and for that purpose shall be, and shall have the powers and duties of, a Constructing Authority within the meaning of the Public Works Act, 1900.

3 . The plan of the said works is the plan marked " Manning ;

Liver Harbour Works," signed by the Secretary for Public Works, and countersigned by the Chief Engineer for Harbours and Water

4 . The cost of carrying out the said works, estimated at one hundred and fifty thousand pounds, may he defrayed from such Loan Votes as are now or may hereafter he applicable to that purpose, or from appropriations of the Public Works Fund, or partly from such votes and partly from such appropriations, and shall not, under any circumstances, exceed the estimated cost by more than ten per centum.

SCHEDULE.

i. The extension in an easterly direction, a distance, of 24(1 feet, of the break water on the northern side of the Manning River entrance, tinted in red on deposited plan, and marked " Extension of Northern Breakwater."

2. The extensions of the harrier bank on the southern side of the entrance to the Manning River in a southerly direction a distance of 3,275 feet, and in a northerly direction a distance of 3,87~> feet, tinted in red on deposited plan, and marked " Extensions of Barrier Bank.''

3. The construction of a, breakwater on the southern side of the entrance to the Manning River, commencing at the northern extremity of the northern extension of the Barrier Bank mentioned above, arid extending on a curve in a northerly and easterly direction a distance of 4,000 feet, tinted in red on deposited plan and marked " Southern Breakwater."

The whole of the above works to be subject to such modifications as may be considered desirable by the Constructing Authority.
