Act No. 44, 1924.

An Act to nrovide for the revesting of certain land in the Parish of Manly Cove, resumed under the Public Works Act, 1912, for the purpose of protecting the purity of the Manly "Water Supply ; and. for purposes connected there-

and in pursuance of the Public Works Act, 1912, published in the Gazette of the first day of December, one thousand nine hundred and twenty-two, the land described in the said notification of resumption (whereof the land described in the Schedule to this Act forms

forms part) "was resumed for a certain public purpose, namely, the protection of the purity of the water supply at Manly : And whereas it has been found that the said land, described in the Schedule to this Act, is not required for the said purpose, and it is desired to revest the same in the persons who were entitled thereto at the time of the said resumption : Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

This Act may be cited as the "Manly Water Supply (Panorama Estate Revesting) Act, 1924."

On the passing of this Act the land described in the First Schedule to this Act shall revest in the persons who were entitled thereto at the time of such resumption as aforesaid and for such estates and interests' and with and subject to such rights as were subsisting in respect of the said land at, the time of such resumption, and such land shall be subject to all trusts, obligations, estates, interests, contracts, charges, rates, rights-of-way or other easements from which it was freed and discharged by such resumption as if the said land had not been resumed, and shall also be subject to any interests in or equities binding on the compensation moneys created since the said resumption.

3. The lands comprised within the Second Schedule to this Act which are shown as public roads on a plan deposited in the office of the Registrar-General and numbered twelve thousand three hundred and fifteen are hereby dedicated as public roads.

4 . Nothing in this Act shall affect the rights of the Minister for Public AVorks or His Majesty or the Government of the State of New South AVales under a certain agreement bearing date the thirty-first day of March, one thousand nine hundred and twenty-four, made between Albert Edwin Lai wood of the first part Ernest Prancis Hartley Brown of the second part the Minister for Public AVorks of the third part and His Alost Gracious Majesty King George A" of the fourth part. parish of Manly Cove, county of Cumber land, and S ta te of N e w South Wales , being pa r t of a road 100 l inks wide (now known as Bangaroo- s t reet ) between parish port ions Nos. 1,196-1,197 and 1,195-1,198, and also par t of 2 acres 1 rood 14 perches resumed in connection with t he Manly wate r supply by notification in Government Gazet te No. 166, da ted the 1st of December, 1922, and conta ining an area of 1 acre 1 rood or thereabouts : Commencing at the nor th-eastern corner of 8 acres 1 rood 151/3 perches resumed by notification in Government Gazet te No. 106, da ted the 1st of December, 1922, and bounded thence on the s o u t h w e s t by pa r t of the north-eastern boundary of t ha t land being a line bear ing south-easterly 1,269-35 l i n k s ; thence on the south-east by a line bear ing north-easterly 100 l inks to the south­ western corner of 18 acres 3 roods 2 4 1 / 2 perches resumed by notification in Government Gazet te No. 65, da ted t he 6 th of May, 1921 ; thence on the north-east by the south-western boundary of t h a t land bear ing north-wester ly 1,233-35 links to the nor th-western corner of the said land, and thence on the nor th by a line bearing westerly 1 0 6 3 l inks to the point of commencement .
