Manly Local Environmental Plan 1988 (Amendment

No 64)

under the

Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Manly Local Environmental Plan 1988 (Amendment

No 64).

2      Aim of plan

The aim of this plan is to amend Manly Local Environmental

Plan 1988:

(a)

to rectify an anomaly (inserted by the amendments made by Manly Local Environmental Plan 1988 (Amendment No 24)) in relation to permitted uses in Zone No 5 (s) Special Uses (Seminary—Heritage) Zone by allowing landscaping for the purposes of pedestrian access and bandicoot habitat within Precincts 7 and 14 of St Patrick’s Estate (as identified on Sheet 1 of the map marked “Manly Local Environmental Plan 1988 (Amendment No 24)”), and

(b)

to expand the permissible uses within Zone No 5 (s) Special Uses (Seminary—Heritage) Zone with respect to Precinct 7 to include roads and drainage works and facilities associated with development of Precincts 1 and 13 and with respect to drainage works and facilities to service development within Precincts 3 and 12, and

(c)

to expand the permissible uses within Zone No 5 (s) Special Uses (Seminary—Heritage) Zone with respect to Precinct 14 to include drainage works and facilities to service development within Precincts 1, 3 and 12, and

(d)

to add a provision providing for the integration of drainage facilities and roads in order to minimise the footprint of new construction within St Patrick’s Estate.

3      Land to which plan applies

This plan applies to land situated in the local government area of Manly at St Patrick’s Estate, in the locality of North Head, as shown edged heavy black on sheet 1 of the map marked “Manly Local Environmental Plan 1988 (Amendment No 24)” deposited in the office of Manly Council.

4 Amendment of Manly Local Environmental Plan 1988

Manly Local Environmental Plan 1988 is amended as set out in

Schedule 1.

Omit item 3 (b) from the matter relating to Zone No 5 (s) in the table to the clause.

Insert instead:

Within Precinct 7 identified on Sheet 1 of the map marked “Manly Local Environmental Plan 1988 (Amendment No 24)”:

Drainage works and facilities, landscaping, roads and swimming pools (all of which are ancillary to the principal use of Moran house, the Cerretti Chapel or St Therese’s Convent); drainage works and facilities to service development within Precincts 1, 3, 12 and 13 identified on Sheet 1 of that map; landscaping required for the provision of pedestrian access or bandicoot habitat (or both); roads associated with development in Precincts 1 and 13 identified on Sheet 1 of that map; tennis courts; utility installations other than generating works or gas holders.

(c)

Within Precinct 14 identified on Sheet 1 of the map marked “Manly Local Environmental Plan 1988 (Amendment No 24)”:

In order to minimise the footprint of new development, drainage works and facilities must be incorporated, where possible, within or under the alignment of roads and other vehicular accessways.
