No 55)

1     Name of plan

This plan is Manly Local Environmental Plan 1988 (Amendment

No 55).

2     Aims of plan

This plan aims to amend Manly Local Environmental Plan 1988 so as

to:

(a)

alter the definition of residential flat building, and

(b)

introduce a definition of multi-dwelling development, and

(c)

update references to the Manly Development Control Plan for the Residential Zone.

3     Land to which plan applies

This plan applies to land within Manly Local Government Area.

4 Amendment of Manly Local Environmental Plan 1988

The Manly Local Environmental Plan 1988 is amended as set out in

Schedule 1.

[1]     Clause 6 Adoption of Model Provisions

Omit “, recreation facility and residential flat building”.

Insert instead “and recreation facility”.

[2]     Clause 7 Interpretation

Insert in alphabetical order in clause 7 (1):

multi-dwelling development means a building containing two or more dwellings, or a group of two or more dwellings on a lot, and includes duplexes, semi-detached dwellings, townhouses, villa homes and residential flat buildings.

Omit the definition of residential flat building.

[4]     Schedule 8 Exempt Development

Omit “Residential Zone (Amendment 3) adopted 7/3/95” from

paragraph (e).

Insert instead “Residential Zone 2001 adopted 24/9/01”.
