An Act to sanction the carrying out of certain

Drainage Works at Manly, in the county

of Cumberland. [12th September, 1889.]
WH E R E A S , cer tain proposed P u b l i c W o r k , namely , " Dra inage W o r k s ,
p u r s u a n t to t he " P u b l i c W o r k s Ac t of 1888 , " a
M a n l y , " was, on t h e twen ty - four th day of J u l y , in t h e year one thousand
e ight h u n d r e d and e ighty-e ight , du ly submi t t ed a n d expla ined by t h e

Secretary for Pub l i c W o r k s in t h e Legislat ive Assembly , and such work was the reupon referred, on t h e mot ion of the said Minister , to t he Pa r l i amen ta ry S tand ing Commit tee on Pub l i c W o r k s , wh ich Commit tee

repor ted the reon to t h e said Assembly in t h e following t e rms , n a m e l y : —
" Tha t t he Commit tee consider i t exped ien t t h a t t h e Dra inage W o r k s
a t M a n l y should be carried out as proposed on t h e p lan , and expla ined
in t h e evidence before t he Commit tee , t h e in t en t ion of t h e Commit tee
by th is resolut ion being to recommend, as a l ready stated, t h e modifi­
cat ion of t h e original p lan by which t h e const ruct ion of t he outfa l l
t u n n e l to Blue P i s h P o i n t will be postponed, and the sewage conveyed

for t h e present to a po in t in t h e vicini ty of L i t t l e Cabbage Tree B a y . " A n d whereas, on t he seventh day of November , in t he year one thousand e ight hundred and e igh ty-e igh t , t h e said Assembly by resolut ion declared " t h a t in accordance wi th t h e Repor t f rom t h e P a r l i a m e n t a r y

S t and ing Commi t t ee on Pub l i c W o r k s , it is expedient t h a t Dra inage

W o r k s a t M a n l y referred to t h e Commit tee for i nqu i ry be carried out as recommended by t h e Commit tee , b y which recommenda t ion a modi­ fied p lan will be adopted, and t h e to ta l es t imated cost will no t exceed Twenty- two thousand pounds . " A n d the said resolut ion was notified

in t h e Gazette on t h e e igh th day of November in t h e said year .
A n d whereas , p u r s u a n t to t h e said Act , it has become t h e d u t y of t he

Minis te r to in t roduce a Bil l in to t h e said Assembly to sanct ion t h e ca r ry ing ou t of such work as aforesaid —Bo it therefore enacted by the Queen ' s Mos t Exce l l en t Majes ty , by and wi th t h e advice and

consent of t h e Legis la t ive Counci l and Legis la t ive Assembly of N e w
South W a l e s in P a r l i a m e n t assembled, and by t h e au thor i ty of t h e

same, as follows :—

1. This A c t m a y be cited as t he " M a n l y Dra inage W o r k s A c t
of 1889 , " and shall be read wi th t h e " Pub l i c W o r k s A c t of 1888 . "
2. T h e Pub l i c W o r k more pa r t i cu la r ly described in t h e Schedule

to th is A c t shall be carried out by t he Secretary for Publ ic Works , or t he M e m b e r of t he Execu t ive Council for t he t ime being charged wi th

t h e dut ies of t he said Minis ter . A n d such Minis ter or M e m b e r
shall , for the purposes of th is A c t and t h e " Pub l ic W o r k s A c t of

1888 , " be deemed and t aken to be t h e " C o n s t r u c t i n g A u t h o r i t y " author ized to enter in to contracts , and to exercise all powers, do all acts and t i l ings, and be responsible in respect of all obligations and liabilities which can be done or incurred by a " Cons t ruc t ing A u t h o r i t y " unde r or p u r s u a n t to th is A c t or t h e said Pub l i c W o r k s Act , so far as m a y be necessary for t h e car ry ing out of t he work hereby sanctioned. The P l a n of such W o r k wi th t he modification recommended by the Commit tee in this A c t referred to is t h e P l a n m a r k e d " M a n l y Dra inage W o r k s " signed by the Secretary for P u b l i c W o r k s and counters igned by t h e Commissioner and Eng inee r for Roads and

deposited in t h e office of t he said Secretary for Pub l ic W o r k s .

3 . The cost of car ry ing ou t t h e work hereby sanctioned, shall be defrayed from moneys to be provided by loan, b u t such cost shal l be repaid to the Colonial Treasurer , to be by h i m carried to a Loan Trus t F u n d , by the Munic ipa l i ty served by such work , upon the t ransfer thereof, after complet ion, by t h e " C o n s t r u c t i n g A u t h o r i t y " to t h e Council of such Munic ipa l i ty . Such cost shal l be a debt chargeable upon t h e general revenues , f rom whatever sources derived, of such Munic ipa l i ty u n t i l def rayed: Provided t h a t such debt shal l be l iquidated by t h e Munic ipa l i ty aforesaid, and be recoverable by the " Cons t ruc t ing A u t h o r i t y " in t h e same m a n n e r as is provided in P a r t F i v e of t h e " Metropol i tan W a t e r and Sewerage A c t of 1880" for t he l iquidat ion and recovery of expenses incur red for sewerage works thereby sanctioned. A n d P a r t s F ive and Six of t he said A c t shall apply to such Munic ipa l i ty in all respects as if instead of t h e words " Boa rd" or " Pres ident of the B o a r d " t h e words " Secretary for Publ ic W o r k s or t h e M e m b e r of t he Execu t ive Council for t he t ime being

charged wi th t h e dut ies of t he said Minis te r" were there in subst i tu ted .

Sewerage and Drainage Works—Manly.
I n the parish of M a n l y Cove, Munic ipal distr ict of Manly , county of Cumber land.
1. The const ruct ion of the por t ion of t h e main outfall sewer be tween A s h b u r n e -

s t ree t and Li t t le Cabbage-tree Bay, about th ree hundred and fifty yards in length , marked " t u n n e l , four feet two inches by two feet six inches ," in red on plan, and a temporary

length , marked by red l ine on plan, together with shafts, manholes, penstock chambers, outfall sewer in L i t t l e Cabbage- t ree Bay , about two h u n d r e d and th i r ty - four yards in
ou t l e t chambers, s torm-water overflow, vent i la t ing shafts , and all works incidental there to .
2. The cons t ruc t ion of four sub-mains compris ing a to ta l length of about one
mile two hundred and fifty-three yards of sewer, toge ther with shafts, manholes, ven­
t i la t ing shafts and pipes, vent i la tors , s torm-water overflows, flushing chambers , and all
works incidental thereto , marked in red lines on plan.
3 . T h e cons t ruc t ion of about four miles seven h u n d r e d and th ree yards of subsi­

diary sewers in various s t reets , toge ther wi th manholes , lampholes , flushing chambers , vent i la t ing shafts and pipes, venti lators , au tomat ic Hushing chambers, and all works -incidental there to , marked in blue lines on plan.

4. The in te rcept ion of about nine hundred yards of exis t ing pipe sewers in six s t ree ts , as marked in green lines on plan, inc luding necessary repairs to sewers in Raglan-s t ree t and M a r k e t - l a n e ; t he construct ion of manholes and vent i la tors , and a screening chamber in Eus tace - s t r ee t ; t h e disconnect ion and discont inuance of about five hundred and forty-one yards of sewer pipes in n ine s t reets no longer necessary, and the uti l ization of about one mile for ty- three yards of exis t ing sewers and outfalls as surface, rainfall , and s tormwater drains .
The works above described a re subject to such deviations and modifications of rou te , and to such al terat ions, omissions, or extensions as may hereaf ter be deemed necessary by t h e Gove rno r : Provided always t h a t t he to ta l cost of such works, toge ther wi th the deviations referred to , shall no t exceed the beforement ioned amoun t of twenty-

two thousand p o u n d s .
