The Parliament of Western Australia enacts as follows:

1.Short title

This is the Mandatory Testing (Infectious Diseases) Amendment (COVID‑19 Response) Act 2020.

2.Commencement

This Act comes into operation as follows —

  • (a)

    sections 1 and 2 — on the day on which this Act receives the Royal Assent;

  • (b)

    the rest of the Act — on the day after that day.

3.Act amended

This Act amends the Mandatory Testing (Infectious Diseases) Act 2014.

4.Section 3 amended

In section 3 delete “blood” (each occurrence).

5.Section 4 amended
  • (1)

    In section 4 delete the definition of qualified person.

  • (2)

    In section 4 insert in alphabetical order:

     

qualified person means —

  • (a)

    the holder of —

  • (i)

    a Certificate III in Pathology Collection from a college as defined in the Vocational Education and Training Act 1996 section 5(1); or

  • (ii)

    an equivalent qualification from an institution based in another State or Territory or overseas;

or

  • (b)

    in relation to the taking of a sample of a particular type — a person, or class of persons, prescribed for the taking of that type of sample;

sample means a sample of blood, saliva, mucus, respiratory secretions or other material taken from a person;

6.Section 7 amended

In section 7(1) in the definition of disease test approval delete “blood”.

7.Section 10 amended

In section 10(2):

  • (a)

    in paragraph (b) delete “of the suspected transferor’s blood;” and insert:

     

from the suspected transferor;

 
  • (b)

    in paragraphs (d) and (e) delete “blood”.

8.Section 12 amended

In section 12 delete “blood” (each occurrence).

9.Section 15 amended

In section 15 in the definition of disease test order delete “blood”.

10.Section 19 amended
  • (1)

    In section 19(1)(b) delete “blood”.

  • (2)

    In section 19(2):

    • (a)

      in paragraph (b) delete “of the suspected transferor’s blood;” and insert:

       

    from the suspected transferor;

     
    • (b)

      in paragraphs (d) and (e) delete “blood”.

    11.Section 22 amended
