His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Maritime Services Act 1935.

Explanatory note
The object of this Regulation is to amend the Management of Waters and Waterside Lands Regulations—N.S.W. to remove certain provisions and update a reference as a consequence of the repeal of the Boating (Safety Equipment) Regulation—N.S.W., the Navigation (Collision) Regulations 1983 and the Water Traffic Regulations—N.S.W..
This Regulation is made under the Maritime Services Act 1935, including sections 30D and

38 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Management of Waters and Waterside Lands
Amendment Regulation 2009.

2      Commencement

This Regulation commences on 30 March 2009 and is required to be published on the NSW legislation website.

[1]      Regulation 4AB Changes in terminology following dissolution of Maritime Services Board

Omit “, 18” from Regulation 4AB (1) (a).

[2]      Regulation 18 Restrictions on use of waters

Omit the Regulation.

[3]      Regulation 35 Classification of occupation licences and fees—boatshed or similar business activity etc

Omit Regulation 35 (1) (a) (iii). Insert instead:

(iii)      the subject of an aquatic licence under the Marine Safety (General) Regulation 2009.

[4] Regulation 121 Application of section 30D—prescribed offences under the Navigation (Collision) Regulations 1983

Omit the Regulation.

[5] Seventh Schedule Prescribed offences and penalties for the purposes of section 30D (offences under the Navigation Act 1901)

Omit the Schedule.
