HAYNE J:   This matter was listed for hearing on Thursday 22 April 2010 before Justices Heydon, Bell and myself.  The parties have now filed a consent to the making of orders in the following terms:

1.That there be an order in the nature of certiorari to set aside the decision of the defendant made on 28 May 2009 to refuse the plaintiff’s application for a subclass 165 State/Territory Sponsored Investor (Provisional) visa.

2.That there be an order in the nature of mandamus to remit the matter to the defendant to be determined according to law.

3.That the defendant pay the plaintiff’s costs.

The Court makes those orders.
