1. The applicant seeks special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of New South Wales (Gleeson JA, Mitchelmore and Adamson JJA agreeing), dismissing an appeal from a decision of the District Court of New South Wales (Kumar DCJ).

2. The proposed appeal would not enjoy sufficient prospects of success to warrant a grant of special leave to appeal.
