Part1Preliminary1Name of Rules

These Rules are the Major Sporting Events (Indicia and Images) Protection Rules 2014.

2Commencement

These Rules commence:

1. (a)

   if the Rules are registered before the Act commences―at the same time as the Act commences; or

2. (b)

   if the Rules are registered on or after the day on which the Act commences―on the date on which the Rules are registered,

whichever occurs first.

Note: Exercise of power conferred by an Act may be exercised before the start time as if the relevant commencement had occurred ― see section 4 of the Acts Interpretation Act 1901.

3Definitions

Note: Terms used in these Rules have the same meaning as in the Act―see section 13 of the Legislative Instruments Act 2003.

In these Rules:

Act means the Major Sporting Events (Indicia and Images) Protection Act 2014.

Part 2Interpretation

4Dictionary

For section 9 Dictionary of the Act:

1. (a)

   the action period in relation to particular seized goods is 10 working days;

2. (b)

   the claim period in relation to particular seized goods is 10 working days.

4ANotice of objection to importation

For paragraph 23(3) of the Act, the following document must accompany a notice of objection to importation:

1. (a)

   Form B1274, Major Sporting Events (Indicia and Images) Protection Act 2014 Security Under Section 25(3) – Deed of Undertaking.

Note:Form B1274 can be found at level="2" section-type="Part">Part3Importation of Goods5Claim for release of seized goods

1. For paragraph 29(3)(b) of the Act, the claim must include the following

   information:

   1. (a)

      the designated owner’s full name;

   2. (b)

      the designated owner’s home or business address;

   3. (c)

      the designated owner’s address for service;

   4. (d)

      the designated owner’s telephone number;

   5. (e)

      the grounds for seeking the release of the seized goods;

   6. (f)

      if the designated owner’s home or business address is not in Australia:

      1. (i)

         the full name of a person who is the designated owner’s agent in Australia;

      2. (ii)

         the home or business address of a person who is the designated owner’s agent in Australia;

      3. (iii)

         the address for service for the person who is the designated owner’s agent in Australia;

      4. (iv)

         a telephone number for the designated owner’s agent;

      5. (v)

         evidence that the person agreed to be the designated owner’s agent.

   7. (g)

      if a person or body other than the agent made arrangements on the designated owner’s behalf for the seized goods to be brought to Australia:

      1. (i)

         the full name of the person or body;

      2. (ii)

         the home or business address of the person or body;

      3. (iii)

         the address for service of the person or body;

      4. (iv)

         a telephone number for the person or body.

Part4Remedies6Damages or accounts of profits

For paragraph 48(6)(b) of the Act, the following provisions of a law of a State or Territory apply in relation to the following major sporting events:

(1)

AFC Asian Cup 2015

1. (a)

   Major Events Act 2009 (NSW), section 63;

2. (b)

   Major Sporting Events Act 2009 (Vic), sections 48 and 49.

Cricket World Cup 2015

1. (a)

   Major Events (Aerial Advertising) Act 2009 (WA), section 14;

2. (b)

   Major Events Act 2009 (NSW), section 63;

3. (c)

   Major Sporting Events Act 2009 (Vic), sections 48 and 49.

Gold Coast 2018 Commonwealth Games

1. (a)

   Commonwealth Games Arrangements Act 2011 (Qld).

For Schedule 1, paragraph 4(1)(c) of the Act, the following expressions or combination of one or more expressions are prescribed for the AFC Asian Cup 2015:
