This regulation is the Major Events Regulation 2025.

2Commencement

This regulation commences on the day on which this regulation is published on the NSW legislation website.

3Definitions

In this regulation—

AFC Women’s Asian Cup 2026, for Part 2—see section 5.

associated events, for Part 2—see section 5.

the Act means the Major Events Act 2009.

Note—

The Act and the Interpretation Act 1987 contain definitions and other provisions that affect the interpretation and application of this regulation.

Part 2AFC Women’s Asian Cup 20264Application of part

This part applies in relation to the AFC Women’s Asian Cup 2026.

5Definitions

In this part—

AFC Women’s Asian Cup 2026 means the AFC Women’s Asian Cup 2026 and associated events.

associated events means an event directly associated with the AFC Women’s Asian Cup 2026 and includes training sessions, competitions, official ceremonies, community events, media events and broadcast centre activities.

6Declaration of AFC Women’s Asian Cup 2026 as major event(1)

For the Act, section 5(1) the AFC Women’s Asian Cup 2026 is declared to be a major event.

Note—

The Act, section 5A(1) enables the Minister to, by order published in the Gazette, specify certain matters in relation to a declared major event.

(2)

For the Act, section 5(4), the AFC Women’s Asian Cup comprises a women’s football tournament sanctioned by the Asian Football Confederation and associated events taking place in New South Wales during the major event period at the major event area.

Note—

The Act, sections 4B and 5A provide for the major event area to be declared and the major event period and area to be specified by the Minister by order published in the Gazette.

7Responsible authority

For the Act, section 6(a), Destination NSW is designated.

8Application of the Act, section 38

For the Act, section 13(2), the Act, section 38 is declared to apply to the AFC Women’s Asian Cup 2026.

9Applications for approvals to sell or distribute prescribed articles(1)

This section applies if the Minister has made a Ministerial order declaring that the Act, section 37 applies to the AFC Women’s Asian Cup 2026.

(2)

For the Act, section 37(8), an application for a prescribed articles sales approval must be made in accordance with this section.

(3)

The application must—

  • (a)

    be made in writing to the responsible authority, and

  • (b)

    be accompanied by the fee, if any, determined by the responsible authority, and

  • (c)

    specify the controlled area in relation to which the approval is sought, and

  • (d)

    include the information and be accompanied by the documents the responsible authority requires to enable the responsible authority to properly consider and decide the application, and

  • (e)

    be lodged with the responsible authority at least 14 days, or a shorter period determined by the responsible authority, before the beginning of the sales control period.

(4)

The responsible authority may require an applicant to give the authority additional information or documents before deciding the application.

(5)

The responsible authority may waive or reduce a fee referred to in subsection (3)(b).

(6)

The responsible authority must decide an application by—

  • (a)

    granting the application unconditionally or subject to conditions, or

  • (b)

    refusing the application.

(7)

As soon as practicable after deciding the application, the responsible authority must give the applicant written notice of the decision.

(8)

Despite subsection (6), the responsible authority may refuse to decide an application if the applicant contravenes—

  • (a)

    the requirements of subsection (3), or

  • (b)

    a requirement to give information under subsection (4).

(9)

The responsible authority is taken to have refused an application if the responsible authority fails to give an applicant written notice of a decision before the beginning of the period for which the approval is sought.

(10)

In this section—

prescribed articles sales approval means the approval of the responsible authority to sell or distribute a prescribed article during the sales control period in a controlled area for the Act, section 37.

10Delegation of responsible authority’s functions in relation to AFC Women’s Asian Cup 2026

For the Act, section 68(3)(d), the Local Organising Committee AFC Women’s Asian Cup 2026 Pty Ltd, ABN 63 681 496 006 is prescribed.

11Delegation to authorised officers

For the Act, section 69A(2)(c), the following classes of persons are prescribed—

  • (a)

    employees of the Local Organising Committee AFC Women’s Asian Cup 2026 Pty Ltd, ABN 63 681 496 006,

  • (b)

    employees of contractors and subcontractors engaged by the Local Organising Committee AFC Women’s Asian Cup 2026 Pty Ltd, ABN 63 681 496 006 for the AFC Women’s Asian Cup 2026.

12Penalty notices(1)

For the Act, section 73(2) and (4)—

  • (a)

    each offence created by an applied provision specified in Schedule 1 is an offence for which a penalty notice may be issued during the offence period for the applied provision, and

  • (b)

    the amount payable for the penalty notice is the amount specified opposite the applied provision in the first column.

(2)

If the applied provision is qualified by words that restrict the operation of the provision to limited kinds of offences or to offences committed in limited circumstances, the penalty notice may be issued only for—

  • (a)

    that limited kind of offence, or

  • (b)

    and offence committed in those limited circumstances.

(3)

In this section—

applied provision means—

  • (a)

    the Act, section 38, and

  • (b)

    a provision of the Act, Part 4 that the Minister has declared, under the Act, section 13(1), applies to the AFC Women’s Asian Cup 2026.

offence period, for an applied provision, means—

  • (a)

    for the Act, section 38—the major event period, or

  • (b)

    otherwise—

    • (i)

      the major event period, or

    • (ii)

      if a shorter period is specified in the Ministerial order under the Act, section 13(1) as the period for which the provision applies—the shorter period.
