Major Events (Pacific Airshow Gold Coast) Regulation 2024

Part 1    Preliminary

1   Short title

This regulation may be cited as the Major Events (Pacific Airshow Gold Coast) Regulation 2024.

2   Definitions

In this regulation—

crowd controller see the Security Providers Act 1993, section 5.

Pacific Airshow Gold Coast means the major event prescribed under section 3.

security officer see the Security Providers Act 1993, section 7.

Part 2    Pacific Airshow Gold Coast

3   Pacific Airshow Gold Coast prescribed as major event—Act, s 12

For section 12(1) of the Act, the event known as the Pacific Airshow Gold Coast to be held in 2024 is prescribed as a major event.

4   Major event organiser—Act, s 12

For section 12(2)(a) of the Act, Pacific Airshow Pty Ltd ACN 647 800 539 is prescribed as the major event organiser for the Pacific Airshow Gold Coast.

5   Major event areas—Act, s 12

For section 12(2)(b) of the Act, each of the areas stated in schedule 1, column 1 is prescribed as a major event area for the Pacific Airshow Gold Coast.

6   Major event period—Act, s 12

For section 12(2)(c) of the Act, the period prescribed as the major event period for the Pacific Airshow Gold Coast is the period—

(a)starting on 16 August 2024 at 6a.m.; and

(b)ending on 18 August 2024 at 5.30p.m.

7   Application of Act provisions to Pacific Airshow Gold Coast—Act, s 12

For section 12(2)(d)(i) of the Act, the following provisions of the Act are prescribed as provisions that apply to the Pacific Airshow Gold Coast for the major event period—

(a)section 31, other than subsection (1)(a);

(b)section 36.

8   Application of Act provisions to major event areas—Act, s 12

For section 12(2)(d)(ii) of the Act, the provisions of the Act stated in schedule 1, column 2 are prescribed as provisions that apply to the major event area stated opposite in schedule 1, column 1 for the period stated opposite in schedule 1, column 3.

9   Controlled area—Act, s 12

For section 12(3)(a) of the Act, the area shown on the map in schedule 2, part 7 as the Surfers Paradise controlled area is prescribed as a controlled area for the Pacific Airshow Gold Coast.

Note—

The areas shown on the maps in schedule 2, parts 2, 3, 4 and 6 as the Surfers Paradise controlled area are included for information purposes only.

10   Control period—Act, s 12

For section 12(3)(b) of the Act, the period prescribed as the control period for the Pacific Airshow Gold Coast is the period—

(a)starting on 16 August 2024 at 6a.m.; and

(b)ending on 18 August at 5.30p.m.

11   Application of Act provisions to controlled area—Act, s 12

For section 12(3)(c) of the Act, sections 30 to 35 of the Act are prescribed as provisions that apply to the controlled area prescribed under section 9 for the following periods—

(a)16 August 2024 from 6a.m. to 5.30p.m.;

(b)17 August 2024 from 6a.m. to 5.30p.m.;

(c)18 August 2024 from 6a.m. to 5.30p.m.

Part 3    Temporary works

12   Carrying out temporary works for Pacific Airshow Gold Coast—Act, s 16

(1)This section applies in relation to the following major event areas for the Pacific Airshow Gold Coast—

(a)the area shown as the Appel Park major event area on the map in schedule 2, part 1;

(b)the area shown as the Surfers Paradise major event area on the map in schedule 2, part 7.

(2)For section 16(2) of the Act, the following periods are prescribed—

(a)from 5 August 2024 at 6a.m. to 16 August 2024 at 6a.m.;

(b)from 18 August 2024 at 5.30p.m. to 23 August 2024 at 5.30p.m.

Part 4    Official logo and official title

13   Official logo—Act, s 51

For section 51(1)(a) of the Act, the logo shown in schedule 3, and a black and white copy of the logo, is declared to be an official logo for the Pacific Airshow Gold Coast.

14   Official title—Act, s 51

For section 51(1)(b) of the Act, the title ‘Pacific Airshow Gold Coast’ is declared to be an official title for the Pacific Airshow Gold Coast.

Part 5    Authorised persons

15   Authorised persons—Act, s 56

For section 56(1)(d) of the Act, the other persons prescribed for the Pacific Airshow Gold Coast are—

(a)a crowd controller; and

(b)a security officer.

16   Limit on powers of particular authorised persons—Act, s 57

(1)For section 57(2) of the Act, this section limits the powers of particular authorised persons for the Pacific Airshow Gold Coast.

(2)An authorised person may exercise a power under section 18(5) or 25 of the Act only if the person is—

(a)a police officer; or

(b)a crowd controller; or

(c)a security officer.

(3)Also, an authorised person may exercise a power under any of the following sections of the Act only if the person is a police officer—

(a)section 30(4);

(b)section 32(5);

(c)section 33(4);

(d)section 54(2);

(e)section 63;

(f)section 65(2).
