The Parliament of Victoria enacts:

Part 1—Preliminary

1Purposes

The main purposes of this Act are—

(a)to amend the Major Events Act 2009

(i)to prevent the unauthorised advertising and sale of ticket packages for sports ticketing events and ticketed events to which a major event ticketing declaration applies; and

(ii)to require sports event organisers and ticketed event organisers to keep a public register of authorised ticket package sellers for sports ticketing events and ticketed events to which a major event ticketing declaration applies; and

(iii)to require ticket resellers to provide the asking price, face value price and seating allocation of a ticket in any resale advertisement for sports ticketing events and ticketed events to which a major event ticketing declaration applies; and

(b)to make related consequential amendments.

2Commencement

(1)Subject to subsection (2), this Act comes into operation on a day or days to be proclaimed.

(2)If a provision of this Act does not come into operation before 16 November 2022, it comes into operation on that day.

3Principal Act

In this Act, the Major Events Act 2009 is called the Principal Act.

Part 2—Amendment of Principal Act

Division 1—Preliminary

4Definitions

In section 3(1) of the Principal Act insert the following definitions—

"ABN has the same meaning as it has in the A New Tax System (Australian Business Number) Act 1999 of the Commonwealth;

ACN has the same meaning as it has in section 9 of the Corporations Act;

authorised ticket package seller means—

(a)in relation to a sports ticketing event, a person authorised in writing by the sports event organiser to sell or distribute tickets for the sports ticketing event in a ticket package; or

(b)in relation to a ticketed event to which a major event ticketing declaration applies, a person authorised in writing by the ticketed event organiser to sell or distribute tickets to the ticketed event in a ticket package;

face value price means the price of a ticket that is set or agreed to by the sports event organiser or ticketed event organiser at the time that the ticket is first sold, excluding the cost of any commission, booking fee, administration fee, surcharge or other cost incurred in connection with the sale or distribution of the ticket;

register of authorised ticket package sellers means the register required to be kept under section 160A or section 182GA;

seating allocation means the location from which a person is authorised to view or experience an event and includes—

(a)any seat number, letter or other identifier; and

(b)any number, letter or other identifier that describes the row, level, bay, stall or area in which a seat is located (however described); and

(c)if the ticket provides for a general seating allocation, any number, letter or other identifier that describes the area within which a person is authorised to view the event, including whether the ticket is for general or limited admission; and

(d)if the ticket provides for a standing allocation, any number, letter or other identifier that describes the area within which a person is authorised to view the event, including whether the ticket is for general or limited admission;

ticket package, in Part 9 or 9A, means the sale or distribution of tickets for a sports ticketing event or a ticketed event to which a major event ticketing declaration applies that is contingent on the supply of other goods or services;".

Division 2—Amendments to sports event ticketing

5New sections 160A, 160B and 160C inserted

After section 160 of the Principal Act insert

160ARegister of authorised ticket package sellers"

(1)For each sports ticketing event, the sports event organiser of the sports ticketing event must keep a register of authorised ticket package sellers.

(2)The register must include—

(a)the full name or business name (as the case requires) of each authorised ticket package seller; and

(b)the ABN or ACN (as the case requires) of each authorised ticket package seller; and

(c)the Internet site of each authorised ticket package seller where ticket packages are authorised to be sold; and

(d)if a person included on the register ceases to be an authorised ticket package seller, the date the authorisation ceased.

(3)The sports event organiser must take reasonable steps to ensure that the information included on the register is accurate.

(4)Without limiting subsection (3), the sports event organiser must update the register as soon as practicable if—

(a)the sports event organiser becomes aware that the information included on the register is not accurate; or

(b)a person included on the register ceases to be an authorised ticket package seller; or

(c)a person who is not included on the register becomes an authorised ticket package seller.

(5)Subject to subsection (6), the sports event organiser must publish the register on the official Internet site of the sports ticketing event—

(a)before any tickets (whether or not in a ticket package) to the sports ticketing event are advertised or offered for sale; and

(b)until after the completion of the sports ticketing event.

(6)If there are no authorised ticket package sellers in relation to a sports ticketing event, the sports event organiser must publish a statement to that effect on the official Internet site of the sports ticketing event before any tickets to the sports ticketing event are advertised or offered for sale.

(7)For the purposes of subsections (5) and (6), the official Internet site of the sports ticketing event is—

(a)an Internet site owned and maintained by the sports event organiser that is the main source of information for the public in relation to the sports ticketing event; or

(b)if there is no Internet site referred to in paragraph (a), the main Internet site of the sports event organiser.

160BCopy of register of authorised ticket package sellers to be provided to Minister

The sports event organiser must provide a copy of the register of authorised ticket package sellers for a sports ticketing event to the Minister as soon as practicable after the completion of the sports ticketing event.

160CInformation to be included in advertising of tickets as part of a ticket package

An authorised ticket package seller must include the following information in any advertisement or offer for sale of tickets for the sports ticketing event in a ticket package—

(a)the authorised ticket package seller's full name or business name (as the case requires);

(b)the authorised ticket package seller's ABN or ACN (as the case requires);

(c)a statement that the authorised ticket package seller is authorised by the sports event organiser to sell or distribute tickets to the sports ticketing event in a ticket package.".

6Ticketing guidelines

In section 163(2A) of the Principal Act omit "purchase" (where twice occurring).

7Sale of 5 or less tickets at a premium (scalping)

In section 166A(1)(b) of the Principal Act omit "purchase" (where twice occurring).

8Advertising for resale of 5 or less tickets at a premium

In section 166B(1)(b) of the Principal Act omit "purchase" (where twice occurring).

9New sections 166C to 166G inserted

After section 166B of the Principal Act insert

"166C   Unauthorised sale of tickets as part of a ticket package

(1)A person who is not an authorised ticket package seller must not sell or distribute 5 or less ticket packages for a sports ticketing event.

Penalty:30 penalty units in the case of a natural person;

150 penalty units in the case of a body corporate.

(2)A person who is not an authorised ticket package seller must not, without reasonable excuse, knowingly sell or distribute 6 or more ticket packages for a sports ticketing event.

Penalty:60 penalty units in the case of a natural person;

300 penalty units in the case of a body corporate.

(3)If a person is guilty of more than one offence against subsection (1) or (2) in respect of a particular sports ticketing event held on a particular day, the total fine payable by the person must not exceed—

(a)600 penalty units in the case of a natural person; or

(b)3000 penalty units in the case of a body corporate.

166DAdvertising unauthorised sale of tickets as part of a ticket package

(1)A person who is not an authorised ticket package seller must not advertise or offer for sale 5 or less ticket packages for a sports ticketing event.

Penalty:30 penalty units in the case of a natural person;

150 penalty units in the case of a body corporate.

(2)A person who is not an authorised ticket package seller must not, without reasonable excuse, knowingly advertise or offer for sale 6 or more ticket packages for a sports ticketing event.

Penalty:60 penalty units in the case of a natural person;

300 penalty units in the case of a body corporate.

(3)If a person is guilty of more than one offence against subsection (1) or (2) in respect of a particular sports ticketing event held on a particular day, the total fine payable by the person must not exceed—

(a)600 penalty units in the case of a natural person; or

(b)3000 penalty units in the case of a body corporate.

166EFalsely claiming to be authorised to sell tickets as part of a ticket package

(1)A person who is not an authorised ticket package seller must not, without reasonable excuse, knowingly claim to be authorised to sell tickets for a sports ticketing event in a ticket package.

Penalty:60 penalty units in the case of a natural person;

300 penalty units in the case of a body corporate.

(2)If a person is guilty of more than one offence against subsection (1) in respect of a particular sports ticketing event held on a particular day, the total fine payable by the person must not exceed—

(a)600 penalty units in the case of a natural person; or

(b)3000 penalty units in the case of a body corporate.

166FMandatory advertising requirements for resale of tickets

(1)A person must not advertise or offer for resale 5 or less tickets for a sports ticketing event unless the following information is included in that advertisement or offer for resale—

(a)the asking price or intended sale price of each ticket;

(b)the face value price of each ticket;

(c)the seating allocation of each ticket.

Penalty:30 penalty units in the case of a natural person;

150 penalty units in the case of a body corporate.

(2)A person must not, without reasonable excuse, knowingly advertise or offer for resale 6 or more tickets for a sports ticketing event unless the following information is included in that advertisement or offer for resale—

(a)the asking price or intended sale price of each ticket;

(b)the face value price of each ticket;

(c)the seating allocation of each ticket.

Penalty:60 penalty units in the case of a natural person;

300 penalty units in the case of a body corporate.

(3)If a person is guilty of more than one offence against subsection (1) or (2) in respect of a particular sports ticketing event held on a particular day, the total fine payable by the person must not exceed—

(a)600 penalty units in the case of a natural person; or

(b)3000 penalty units in the case of a body corporate.

(4)This section does not apply to the advertisement or offer for resale of tickets for a sports ticketing event in a ticket package by an authorised ticket package seller.

166GFailing to provide accurate information in advertising tickets for resale

(1)A person must not advertise or offer for resale 5 or less tickets for a sports ticketing event if that advertisement or offer for resale includes information that is incomplete or inaccurate in relation to—

(a)the face value price of a ticket; or

(b)the seating allocation of a ticket.

Penalty:30 penalty units in the case of a natural person; 

150 penalty units in the case of a body corporate.

(2)A person must not, without reasonable excuse, knowingly advertise or offer for resale 6 or more tickets for a sports ticketing event if that advertisement or offer for resale includes information that is incomplete or inaccurate in relation to—

(a)the face value price of a ticket; or

(b)the seating allocation of a ticket.

Penalty:60 penalty units in the case of a natural person;

300 penalty units in the case of a body corporate.

(3)If a person is guilty of more than one offence against subsection (1) or (2) in respect of a particular sports ticketing event held on a particular day, the total fine payable by the person must not exceed—

(a)600 penalty units in the case of a natural person; or

(b)3000 penalty units in the case of a body corporate.

(4)This section does not apply to the advertisement or offer for resale of tickets for a sports ticketing event in a ticket package by an authorised ticket package seller.".

10Infringement notices, penalties and offences for this Part

(1)In section 167A(1) of the Principal Act, for "or 166B" substitute ", 166B, 166C(1), 166D(1), 166F(1) or 166G(1)".

(2)For section 167A(3) of the Principal Act substitute

"(3)The infringement penalty for an offence referred to in subsection (1) is 5 penalty units in the case of a natural person or 25 penalty units in the case of a body corporate.".

11Seizure of tickets

(1)In section 167B(1) of the Principal Act, for "or 166B" (where twice occurring) substitute ", 166B, 166C, 166D, 166E, 166F or 166G".

(2)In section 167B(2) of the Principal Act, for "or 166B" substitute ", 166B, 166C(1), 166D(1), 166F(1) or 166G(1)".

12Temporary surrender of tickets by purchaser for evidentiary purposes

In section 167C(1) of the Principal Act, for "or 166B" substitute ", 166B, 166C, 166D, 166E, 166F or 166G".

13Retention of tickets seized from scalper for purpose of proceedings

In section 167D(a) of the Principal Act—

(a)in subparagraph (i), for "or 166B" substitute ", 166B, 166C, 166D, 166E, 166F or 166G";

(b)in subparagraph (ii), for "or 166B" substitute ", 166B, 166C(1), 166D(1), 166F(1) or 166G(1)".

14Application by scalper to Magistrates' Court for return of tickets

In section 167E(2) of the Principal Act—

(a)in paragraph (a), for "or 166B" substitute ", 166B, 166C, 166D, 166E, 166F or 166G";

(b)in paragraph (b), for "or 166B" substitute ", 166B, 166C(1), 166D(1), 166F(1) or 166G(1)".

15Forfeiture to the Crown

(1)In section 167F(1) of the Principal Act, for "or 166B" substitute ", 166B, 166C, 166D, 166E, 166F or 166G".

(2)In section 167F(2) of the Principal Act, for "or 166B" substitute ", 166B, 166C(1), 166D(1), 166F(1) or 166G(1)".

Division 3—Amendments to major event ticketing

16Price to be displayed on tickets

In section 182E of the Principal Act omit "purchase".

17Ticket scalping (6 or more tickets)

In section 182F of the Principal Act omit "purchase" (where twice occurring).

18Ticket scalping (5 or less tickets)

In section 182G of the Principal Act omit "purchase" (wherever occurring).

19New sections 182GA to 182GH inserted

After section 182G of the Principal Act insert

"182GA   Register of authorised ticket package sellers

(1)For each ticketed event to which a major event ticketing declaration applies, the ticketed event organiser of that event must keep a register of authorised ticket package sellers.

(2)The register must include—

(a)the full name or business name (as the case requires) of each authorised ticket package seller; and

(b)the ABN or ACN (as the case requires) of each authorised ticket package seller; and

(c)the Internet site of each authorised ticket package seller where ticket packages are authorised to be sold; and

(d)if a person included on the register ceases to be an authorised ticket package seller, the date the authorisation ceased.

(3)The ticketed event organiser must take reasonable steps to ensure that the information included on the register is accurate.

(4)Without limiting subsection (3), the ticketed event organiser must update the register as soon as practicable if—

(a)the ticketed event organiser becomes aware that the information included on the register is not accurate; or

(b)a person included on the register ceases to be an authorised ticket package seller; or

(c)a person not included on the register becomes an authorised ticket package seller.

(5)Subject to subsection (6), the ticketed event organiser must publish the register on the official Internet site of the ticketed event—

(a)before any tickets (whether or not in a ticket package) for the ticketed event are advertised or offered for sale; and

(b)until after the completion of the ticketed event.

(6)If there are no authorised ticket package sellers in relation to a ticketed event to which a major event ticketing declaration applies, the ticketed event organiser must publish a statement to that effect on the official Internet site of the ticketed event before any tickets for the ticketed event are advertised or offered for sale.

(7)For the purposes of subsections (5) and (6), the official Internet site of the ticketed event is—

(a)an Internet site owned and maintained by the ticketed event organiser that is the main source of information for the public in relation to the ticketed event; or

(b)if there is no Internet site referred to in paragraph (a), the main Internet site of the ticketed event organiser.

182GBCopy of register of authorised ticket package sellers to be provided to Minister

The ticketed event organiser must provide a copy of the register of authorised ticket package sellers for a ticketed event to which a major event ticketing declaration applies to the Minister as soon as practicable after the completion of the ticketed event.

182GCInformation to be included in advertising of tickets as part of a ticket package

An authorised ticket package seller must include the following information on any advertisement or offer for sale of tickets for a ticketed event to which a major event ticketing declaration applies in a ticket package—

Penalty:30 penalty units in the case of a natural person;

150 penalty units in the case of a body corporate.

(2)A person who is not an authorised ticket package seller must not, without reasonable excuse, knowingly sell or distribute 6 or more ticket packages for a ticketed event to which a major event ticketing declaration.

Penalty:60 penalty units in the case of a natural person;

300 penalty units in the case of a body corporate.

(3)If a person is guilty of more than one offence against subsection (1) or (2) in respect of a particular ticketed event held on a particular day, the total fine payable by the person must not exceed—

(a)600 penalty units in the case of a natural person; or

(b)3000 penalty units in the case of a body corporate.

182GEAdvertising unauthorised sale of tickets as part of a ticket package

182GFFalsely claiming to be authorised to sell tickets as part of a ticket package

(b)3000 penalty units in the case of a body corporate.

(4)This section does not apply to the advertisement or offer for resale of tickets for a ticketed event to which a major event ticketing declaration applies in a ticket package by an authorised ticket package seller.

182GHFailing to provide accurate information in advertising tickets for resale

(1)A person must not advertise or offer for resale 5 or less tickets for a ticketed event to which a major event ticketing declaration applies if that advertisement or offer for resale includes information that is incomplete or inaccurate in relation to—

(a)the face value price of a ticket; or

(b)the seating allocation of a ticket.

Penalty:30 penalty units in the case of a natural person; 

150 penalty units in the case of a body corporate.

(2)A person must not, without reasonable excuse, knowingly advertise or offer for resale 6 or more tickets for a ticketed event to which a major event ticketing declaration applies if that advertisement or offer for resale includes information that is incomplete or inaccurate in relation to—

(a)the face value price of a ticket; or

(b)the seating allocation of a ticket.

Penalty:60 penalty units in the case of a natural person;

300 penalty units in the case of a body corporate.

(3)If a person is guilty of more than one offence against subsection (1) or (2) in respect of a particular ticketed event held on a particular day, the total fine payable by the person must not exceed—

(a)600 penalty units in the case of a natural person; or

(b)3000 penalty units in the case of a body corporate.

(4)This section does not apply to the advertisement or offer for resale of tickets for a ticketed event to which a major event ticketing declaration applies in a ticket package by an authorised ticket package seller.".

20Infringement notices, penalties and offences for this Part

(1)In section 182I(1) of the Principal Act, for "182G(1) or (2)" substitute "182G, 182GD(1), 182GE(1), 182GG(1) or 182GH(1)".

(2)For section 182I(3) of the Principal Act substitute

"(3)The infringement penalty for an offence referred to in subsection (1) is 5 penalty units in the case of a natural person or 25 penalty units in the case of a body corporate.".

21Seizure of tickets

(1)In section 182J(1) of the Principal Act, for "182F(1) or (2) or 182G(1) or (2)" substitute "182F, 182G, 182GD, 182GE, 182GF, 182GG or 182GH".

(2)In section 182J(2) of the Principal Act, for "182G(1) or (2)" substitute "182G, 182GD(1), 182GE(1), 182GG(1) or 182GH(1)".

22Temporary surrender of tickets by purchaser for evidentiary purposes

In section 182K(1) of the Principal Act, for "182F(1) or (2) or 182G(1) or (2)" substitute "182F, 182G, 182GD, 182GE, 182GF, 182GG or 182GH".

23Retention of tickets seized from scalper for purpose of proceedings

In section 182L(a) of the Principal Act—

(a)in subparagraph (i), for "182F(1) or (2) or 182G(1) or (2)" substitute "182F, 182G, 182GD, 182GE, 182GF, 182GG or 182GH";

(b)in subparagraph (ii), for "182G(1) or (2)" substitute "182G, 182GD(1), 182GE(1), 182GG(1) or 182GH(1)".

24Application by scalper to Magistrates' Court for return of tickets

In section 182M(2) of the Principal Act—

26New sections 205C and 205D inserted

After section 205B of the Principal Act insert

"205C   Major Events Legislation Amendment (Unauthorised Ticket Packages and Other Matters) Act 2022—transitional provision

On and from the commencement of the Major Events Legislation Amendment (Unauthorised Ticket Packages and Other Matters) Act 2022, amendments made by that Act apply in relation to any event for which a sports ticketing event declaration or a major event ticketing declaration is in force, irrespective of whether the declaration was made before, on or after that commencement.

205DMajor Events Legislation Amendment (Unauthorised Ticket Packages and Other Matters) Act 2022—grace period

(1)Despite the commencement of section 160A, a sports event organiser is not required to comply with the requirements of that section for a period of 14 days after that commencement.

(2)Despite the commencement of section 182GA, a ticketed event organiser of a ticketed event to which a major event ticketing declaration applies is not required to comply with the requirements of that section for a period of 14 days after that commencement.".

Part 3—Repeal of this Act

27Repeal of this Act

This Act is repealed on 16 November 2023.

Note

The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
