1      Name of Plan

This Plan is Maitland Local Environmental Plan 2011 (Amendment No 16).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to Lot 1, DP 199405 and Lot 1, DP 716770, being 46 and 48 Banks

Street, East Maitland.

4      Amendment of Maitland Local Environmental Plan 2011

(1) Schedule 1 Additional permitted uses

Omit “consent” wherever occurring in clauses 1 (2), 2 (2), 3 (2), 4 (2), 5 (2), 6 (2) and 7 (2).

Insert instead “development consent”.

Insert at the end of the Schedule with appropriate clause numbering:

Use of certain land at 46 and 48 Banks Street, East Maitland

(1)

This clause applies to Lot 1, DP 199405 and Lot 1, DP 716770, being

46 and 48 Banks Street, East Maitland.

(2) Development for the purpose of a mortuary is permitted with

development consent.
