1      Name of Plan

This Plan is Maitland Local Environmental Plan 1993 (Amendment

No 114).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to all land within Zones 1 (a), 1 (b), 1 (c) and 1 (d) under Maitland Local Environmental Plan 1993.

4 Amendment of Maitland Local Environmental Plan 1993

Clause 8 What subdivision controls apply?

Omit clause 8 (2) (e). Insert instead:

a consolidation of lots that does not create the opportunity for additional dwellings, or

Omit the note. Insert instead:

Note. Clause 13 (4) prevents the erection of a dwelling house on an allotment of land in Zone 1 (a), (b), (c) or (d) created by a subdivision under subclause (2) (a), (b), (c), (d), (e) or (f), except an allotment with a minimum area of 40 hectares.

Clause 13 What are the requirements with respect to the erection of

dwellings in rural zones?

Omit “clause 8 (2) (a), (b), (c), (d) or (f), except an allotment with a minimum area of 40 hectares created by a subdivision consolidating allotments” from clause 13 (4).

Insert instead “clause 8 (2) (a), (b), (c), (d), (e) or (f), except an allotment with a minimum area of 40 hectares”.
