[ASSENTED TO 8TH DECEMBER, 1932.] W HEREAS by virtue of the provisions of section twenty-eight of *" The Main Roads Acts, 1920 to 1929," a Fund was created at the Treasury called the "Main Roads Fund "; and whereas by virtue of such section it is provided that certain moneys, taxes, fees, rents, and contributions as set forth in the said section shall be placed to the credit of such Fund: And whereas it is desirable that certain sums of money amounting in all to Two hundred and fifty thousand pounds, whether consisting of portion of the * 10 Geo. 1932. Main Roads Funds Transfer, Etc., Act. "moneys presently standing to the credit of such Fund or of moneys which otherwise would be payable during the financial year ending on the thirtieth day of June, one thousand nine hundred and thirty-three, to the credit of such Fund, shall from time to time during such financial year be diverted from such Fund, and shall be transferred to the Consolidated Revenue: And whereas it was directed by Executive Minutes of the Governor in Council dated the twenty-fifth day of September, one thousand nine hundred and thirty, and the thirty-first day of July, one thousand nine hundred and thirty-one, that during the financial year ending on tile thirtieth day of June, one thousand nine hundred and thirty-one, and during the financial year ending on the thirtieth day of June, one thousand nine hundred and thirty-two, certain sums be paid to the Treasury from the Main Roads Fund to meet interest payments on certain proportions of moneys which had been previously appropriated by Parliament from Loan Funds and paid to the credit of the Main Roads Fund from time to time for the purposes of *" The Main Roads Acts, 1920 to 1929," including sums spent on develop- mental roads (the interest on such amounts and the sinking fund payments for sums spent on developmental roads having been previously paid otherwise than out of the Main Roads Fund or the Developmental Roads Fund) : And whereas it was directed by Executive Minute of the Governor in Council dated the twenty-fifth day of September, one thousand nine hundred and thirty, that sinking fund payments be made from the Main Roads Fund to the Main Roads Sinking Fund on the total amount appropriated by Parliament for the purposes of *" The Main Roads Acts, 1920 to 1929," after deducting the amounts deemed under the said Acts to be loans to Local Authorities on account of permanent works and sinking fund payments have been made from the Main Roads Fund on amounts expended on developmental roads: And whereas there is no provision in the aforesaid Acts authorising the payment of the interest aforesaid and the payment of sinking fund on moneys expended on developmental roads aforesaid: And whereas it is expedient that provision should be made for the validation of and for the continuance * 10 Geo. No. 20, of the payment ·of such interest charges and sinking fund charges aforesaid, and to authorise and empower and to approve, ratify, validate, and confirm such diversion and transfer and payment as herein authorised to be made- Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of same, as follows : - Short title 1. This Act may be cited as "The Main Roads and t t' Fund Transfer Approval Act of 1932," and shall be read cons ruc lon. as one with *" The Main Roads Acts, 1920 to 1929," herein referred to as the Principal Act. Approval, 2. Notwithstanding anything to the contrary t&rac.n,sofferthe contained in the Principal Act or in any other Act or during the law, the Treasurer of Queensland is hereby authorised fyoiennaatrnhceeina3dl0inthg yaneadr eemndpionwgeorend tfhreomthitritmieet h todatiym 0 e f dJuurnien,g otnhee tf h inoaunscaina d l June, 1933, nine hundred and thirty-three, to divert sums of money ~ ~nSOlidated amounting in all to Two hundred and fifty thousand ~evenue of pounds from the Main Roads Fund (constituted as ~2~ ~~ ~ O;ut hereinbefore set forth), and consisting whether of portion of the Main of moneys presently standing to the credit of such Roads Fund. Fund or of moneys which otherwise would be payable pursuant to the Principal Act to the credit of such Fund, and to transfer and pay such sums (amounting in all to Two hundred and fifty thousand pounds) to the Consolidated Revenue. And any such diversion, transfer, and payments are hereby approved, ratified, validated, and confirmed; and the Government of Queensland, and the Treasurer, and the Commissioner of Main Roads, and any officer of the Government are hereby indemnified against all claims and liabilities in respect of such diversion, transfer, and payment accordingly. Repayment 3. The total amounts of all such diversions, transfers, of diversions. and payments from the Main Roads Fund to the Consolidated Revenue as provided in section two of this Act shall be repaid to the Main Roads Fund when in the opinion of the Governor in Council the finances of the State permit. * 10 Geo. On any such transfer, diversion, or payment as Main Roads !e provided in section two aforesaid, the Main Roads F~ nd ! ~ ~eet; t shall be relieved of payment of interest and redemptIOn certain on a!1- amount of Loan Fund previously appropriated by f: le: : ~ ~ ~ ~ ParlIament and credited to the Main Roads Fund for redemption. the purposes of *" The Main Roads Acts, 1920 to 1929," and on which interest and redemption are being paid from the Main -Roads Fund at the time of such transfer, diversion, or payment aforesaid. The amount of Loan Fund aforesaid to which such relief aforesaid shall extend shall be such amount as will equal the amount of such transfer, diversion, or payment, as herein provided, and such relief shaH extend until such time as the amount of the transfer, diversion, or payment as aforesaid is repaid to the Main Roads Fund; and thereupon such interest and redemption payments shall be paid out of the Main Roads Fund until the termination of the period at the end of which the Loan Fund aforesaid would have been redeemed by payments from the Main Roads Fund if such transfer, diversion, or payment as herein provided had not taken place. 5. Save as hereinbefore provided, from the moneys Interest and to the credit of the Main Roads Fund there shall be paid ~ ~ ~ ! ; : ~ ~ o to the Treasury annually interest and redemption at a Treasury on rate to b e fi xe d b y t h e Treasurer on a 11 moneys cmroedneityosfto appropriated before, on, or after the passing of this : ai~ Roads Act by Parliament from Loan Funds and paid to the un. credit of the Main Roads Fund for the purposes of *" The Main Roads Acts, 1920 to 1929," including sums spent on developmental roads less the amounts repayable by Local Authorities on account of such loan as provided in *" The Main Roads Acts, 1920 to 1929," and less the amount of any interest payments on sums spent on developmental roads and payable by Local Authorities; and all payments already made prior to the passing of this Act to the Treasury out of the Main Roads. Fund to meet interest and redemption charges not provided in *" The Main Roads Acts, 1920 to 1929" (as set forth in the preamble to this Act), on such amounts as aforesaid shall by this Act be approved, ratified, validated, and confirmed, and the Government of Ratification Queensland, and the Treasurer, and the Commissioner of paymentds alreadyma e - - - - - - - - - - - - - - - - - - - - - - - - to Treasury * 10 Geo. R N oa o d t s w A it c h t s s t , an1d9i2n0g to an1y9t2h9in, " g thceonptearinceendtainge * t " o T b h e e payments. paid into the Main Roads Sinking Fund as provided in paragraph (c) of section twenty-nine of the said Acts shall be such that the amount of such payments together with compound interest thereon compounded yearly shall at the end of thirty years from the time of commencement of the payments aforesaid into the Main Roads Sinking Fund aforesaid equal the amount of the Loan appropria- tion in each case in respect of which such payments have been made. The rate of interest on such amounts paid into the Main Roads Sinking Fund aforesaid shall be as fixed by the Treasurer. Saving as to 7.
