Main Roads (Amendment) Act 1950 (NSW)

1 . (1) This Act may be cited as the "Main Roads
(Amendment) Act, 1950."
(2) The Main Roads Act, 1924, as amended by subsequent Acts and by this Act, may be cited as the Main Roads Acts, 1924-1950.
(3) This Act shall commence upon the date of commencement of the Motor Vehicles (Taxation) Act, 1950.
2. The Main Roads Act, 1924-1950, is amended:—
(a)
by omitting paragraph (a) of subsection one of section ten and by inserting in lieu thereof the following paragraph:—
(a)
one half of the proceeds of the taxes collected under the Motor Vehicles (Taxa tion) Act, 1950, on vehicles owned by persons resident in the said county, not being vehicles registered under the Transport Act, 1930, such amount to be paid into the fund by the Treasurer not less frequently than once in three months.
For the purposes of this paragraph the
proceeds of the taxes collected under the Motor Vehicles (Taxation) Act, 1950, on vehicles referred to in this paragraph shall be deemed not to include so much of the proceeds collected under that Act as is equivalent to the difference between the taxes upon such vehicles which would have been imposed by the Motor Vehicles (Taxation) Act, 1949, had the Motor Vehicles (Taxation) Act, 1950, not been enacted and those imposed by the Motor Vehicles (Taxation) Act, 1950. (b)
(b)
by omitting paragraph (a) of subsection one of section twenty and by inserting in lieu thereof the following paragraph:—
(a) (i) an amount equivalent to the difference between the amount paid into the County of Cumberland Main Roads Fund pursuant to paragraph (a) of subsection one of section ten of this Act and the proceeds of the taxes collected under the Motor Vehicles (Taxation) Act, 1950, on vehicles owned by persons resident in the County of Cumberland, not being vehicles registered under the Trans port Act, 1930, and
(ii) the whole of the proceeds of such taxes collected on vehicles owned by persons resident outside such county not being vehicles registered under the Transport Act, 1930.
Such amounts shall be paid into
the fund by the Treasurer not less
frequently than once in three months.
3 . (1) The Main Roads Act, 1924-1950, is further
amended:—
(a) by inserting at the end of section twenty-one the following new subsection:— (8) There shall be provided from the Country
Main Roads Fund such sums as may be required
to provide for interest, sinking fund and other loan charges on loans appropriated for develop mental roads and developmental works, and which are required by the Treasurer to be repaid.
The rates, terms and conditions of payment in accordance with this subsection shall be as determined by the Treasurer.
This subsection shall apply to interest, sink ing fund and the loan charges on loans appro priated for developmental roads and develop mental works before the commencement of the
Main
Main Koads (Amendment) Act, 1950, and which K at such commencement were unpaid from the Developmental Eoads Fund, as well as to interest, sinking fund and other loan charges on loans so appropriated after such commence- ment.
(b) (i) by omitting paragraph (e) of subsection one
of section twenty-nine;
(ii) by omitting subsection four of the same section;
(iii) by omitting subsections five and six of the same section.
(2) Tbe amendments made by subparagraph (iii) of paragraph (b) of subsection one of this section shall be deemed to have commenced upon the first day of July, one thousand nine hundred and forty-two.
