368 (Queensland ANNO TERTIO DECIMO ELIZABETHAE SECUNDAE REGINAE No. 39 of 1964 An Act to Amend "The Main Roads Acts, 1920 to 1963," in certain particulars [ASSENTED TO 2ND NOVEMBER, 1964] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows: 1. (1) Short title . This Act may be cited as " The Main Roads Acts Amendment Act of.1 964." (2) Principal Act. " The Mani Roads Acts, 1920 to 1963," are in this Act referred to as the Principal Act. (3) Collective title . The Principal Act and this Act may be collectively cited as " The Main Roads Acts, 1920 to 1964."
Main Roads Acts Amendment Act of 1964, No. 39 369 2. Amendments of s. 2 . Section two of the Principal Act is amended by- (a) omitting the definition " Deputy Commissioner and Chief Engineer " and inserting in its stead the following definition:- " " Deputy Commissioner "-The Deputy Commissioner of Main Roads appointed under this Act: The term includes a person appointed to act in, or for the time being performing the duties of, the office of Deputy Commissioner of Main Roads";-; and (b) inserting after the definition " Maintenance " the following definition:- MMeeddiiaann "-In relation to the carriage-way within the meaning of " The Traffic Acts, 1949 to 1962," of a declared road, a strip of such road formed, prepared or set aside (including by means of the construction, erection, placing or marking thereon or therein of anything) so as to separate longitudinally a part of such carriage-way from the remainder thereof; ". 3. Amendments of s. 3A. Section 3A of the Principal Act is amended by- (a) in subsection (1) omitting the words " and Chief Engineer " and inserting in their stead the words " and a Chief Engineer."; (b) omitting subsection (2) and inserting in its stead the following subsection:- " (2) Confirmation in office . The person who immediately prior to the date of the passing of " The Main Roads Acts Amendment Act of 1964 " held the office of the Deputy Commissioner of Main Roads and Chief Engineer shall, without further or other appointment whatsoever, be deemed to have been appointed under " The Public Service Acts, 1922 to 1963," as the Deputy Commissioner of Main Roads and shall hold office accordingly."; and (c) in subsection (3) omitting the words " and Chief Engineer " and inserting in their stead the words " or to the office of Chief Engineer ". 4. Amendment of s. 4 . Section four of the Principal Act is amended by omitting the words " and Chief Engineer ". 5. Amendment of s. 9 . Section nine of the Principal Act is amended by adding the following subsection:- (5) If, in respect of the carriage-way under and within the meaning of " The Traffic Acts, 1949 to 1962," of any declared road, the Commissioner is of opinion that for the safety of users of such road, or the better control of traffic thereon, or for any other purposes a median is desirable or necessary, the Commissioner may provide such median by forming, preparing or setting aside a strip of land therefor, and by constructing, erecting, placing, or marking on or in such strip of land such things as the Commissioner deems fit."
370 Main Roads Acts Amendment Act of 1964, No. 39 6. New s. 9A inserted . The Principal Act is amended by inserting after section nine, the following section:- " [9A.] Power of Commissioner to be member of inter-State organisations , &c. (1) Notwithstanding anything contained in this or any other Act, the Commissioner may, with the approval of the Minister, become and be a member of (a) the Australian Road Research Board; (b) any Governmental or semi-governmental authority or body, the objects of which are to carry out, encourage or promote the undertaking of road research including research into road planning, location, design, safety, materials, construction, maintenance, structures, equipment, traffic, transport economics, administration, financing, management, accounting and any other matters affecting the provision, upkeep, use, protection and development of roads; and (c) any body, authority or association created or formed to encourage and foster co-operation- (i) amongst the Road Authorities of the States and Territories of the Commonwealth; (ii) between the Road Authorities of the States of the Common- wealth and the appropriate authority of the Commonwealth Government; or (iii) amongst the Local Authorities of the States and Territories of the Commonwealth, in relation to the matters specified in paragraph (b) of this subsection. (2) Where pursuant to subsection (1) of this section the Commissioner is a member of a Board, body, authority or association, the Commissioner may be a member of the directorate or other governing body of the Board, body, authority or association. (3) The Commissioner may pay such contributions as membership of a Board, body, authority or association pursuant to subsection (1) of this section entails." 7. Amendment of s. 13 . Section thirteen of the Principal Act is amended by inserting after subsection (3) the following subsection:- " (3A) Subject to the provisions of subsections (1), (2), (2A) and (3) of this section the Commissioner may- (a) make a new road ; (b) make a deviation from an. existing declared road; (c) widen an existing declared road; (d) carry out permanent improvements to an existing declared road; or (e) carry out drainage works or other necessary works for the protection of any declared road on land adjacent thereto.".
Main Roads Acts Amendment Act of 1964, No. 39 371 8. Amendment of cl. 13 of the Schedule . Clause 13 of the Schedule to the Principal Act is amended by in the third paragraph (being the paragraph commencing with the words " Prescribing the condition to be complied with by applicants "), omitting the words " approved by the Commissioner or on instruments approved by the Commissioner for weighing vehicles " and inserting in their stead the words " or instruments ".
