J B E it enacted by the King's Most Excellent Majesty,. by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled,. and by the authority of the same, as follows:- - Short title 1. This Act maybe cited as "The Main Roads ActS' : ~ ! Btruction Amendment Act of 1925," and shall be read as one with of Act. *"The Main Roads Acts, 1920 to 1923," herein collectively referred. to as the Principal Act. Amendments 2. Section two of the Principal Act is amended as of B. 2. follows:- Commis· Bioner. Employee. (i.) The definition of "Board" is repealed and the following definition is inserted in lieu thereof:- " "Commissioner"-The Commissioner of Main Roads appointed under this Act." (ii.) In the definition of "Authorised officer," the word "Board" where it twice occurs is repealed and the word" Commissioner" is respectively inserted in lieu th€lreof. (iii.) In the definition of " Maintenance," the word " Board" where it thrice occurs is repealed and the word "Commissioner" is respectively inserted in lieu thereof. (iv.) In the definition of "Minister," the words "Public V\rorks" are repealed and the words "Public Lands" are inserted in lieu thereof. - (v.) Mter the definition of "Developmental roa.d" the following definition is inserted:- " "Employee"-Any person whomsoever employed by the Commissioner under this Act." * 10 Geo. V. After the definition of "Newspaper" the fol- lowing definitions are inserted:- " " Occupier"-The person in actual occupation of Occupier. land, or, if there is no person in actualoccu- pation, the person entitled to the possession of the land; "Owner"-Theperson for the time being entitled Owner.· to receive the rents and profits of the land in connection with which the word is used, whether on his own account or as the agent of or trustee for any other person, or who would be entitled to receive the same if the land were let at a rent: the term includes the registered proprietor under the Acts relating to Real Property and any person seised of a .legal interest in land." (vii.) After the definition of "Road" the following definition is inserted :- " "This Act "-This Act and all regulations, This Act. proclamations, and Orders in Council made thereunder.', (ix.) In the definition of "Permanent improvement" the word "-Board" is repealed and the word "Commis- sioner" is inserted in lieu thereof. 3. (1.) Sections three, four, five, six, seven, and Repeal of eight of the Principal Act are repealed. ss. 3 to 8. (2.) The Main Road;; Board is aboli8hed and the Abolition of corporate body heretofore constituted under that name Board. by the Principal Act is dissolved. 4. After section two of the Principal Act the following sections are inserted :- "[3.] (1.) The Governor in Council may from Appoint- time to time, by Commission under his hand and the ~ : ~~ ~ !_ public seal of the State, appoint a Commissioner of Main sioner. No. 9, The Commissioner of Main Roads shall be an engineer and either shall hold a degree or diploma in engineering granted by a recognised University within the British Dominions or shall be an· Associate or Member or Fellow of a recognised Engineers' Institute, Association, or Soc~ ety, and in every case shall have had experience in modern roadmaking, and also administra- tive experience. Disabilities. (2.) The Commissioner shall not act as a director or auditor or in any other capacity take part in the management of any bank, joint stock company, or other financial institution, or of any trade or business, or acquire or hold any interest in any land which is or may be required to be acquired, taken, or occupied for the purposes of this Act; and in any such case shall be disqualified from holding the office of Commissioner. First Corn· (3.) The Chairman of the Main Roads Board holding missioner. office at the date of the passing of " The JJ1 ain Roads Act Amendment Act of 1925" shall be deemed to have been appointed Commissioner of Main Roads under the powers conferred by this section, as on that date, and a com- mission as aforesaid shall forthwith be issued to him. Salary. (4.) The Commissioner shall during his continuance in office receive an annual salary to be fixed by the Governor in Council. Such salary shall be a charge upon and be paid out of the Consolidated Revenue, which is hereby permanently appropriated for that purpose. Future ap· (5.) In respect of any appointment of a Commissioner pointments. subsequent t,1) the appointment hereinbefore provided for, if in the opinion of the Governor in Council it is desirable so to do, the person appointed to be the Commissioner may be appointed on probation only and may be continued on probation for any period not exceeding twelve months, and at the end of the period of probation may be confirmed in his office as Commissioner by the Governor in Council, or, if not so confirmed, shall vacate his office, ·whereupon another qualified person may be appointed to be Commissioner. Suspension (6.) The Commissioner may be suspended from his and removal. office by the Governor· in Council, but shall not be removed from offiGe except as hereinafter provided.

If the Commissioner is so suspended the Minister shall cause to be laid before the Legislative Assembly a full statement of the grounds of such suspension within seven days thereafter, if the Legislative Assembly is in session, or if the Legislative Assembly is not in session, within seven days after the commencement of the next -ensuing session of the Legislative Assembly. The Commissioner so suspended shall. be restored to Dffice unless the Legislative Assembly within twenty-one days from the time when such statement has been laid before it declares by resolution that the Commissioner Dught to be removed from office; and if within the said time the Legislative Assembly so declare, the Commis- sioner shall be removed by the Governor in Council accordingly. (7.) The Commissioner shall be deemed to have Office how vacat ed h I · S 0 ffice- vo at hceartwe di s. e (a) If he is or becomes disqualified under this Act from holding the office of Commissioner; (b) If he engages during his term of office in any . employment outside the duties of his office; (c) If he becomes insolvent or institutes pro- ceedings for liquidation of his affairs by arrangement or composition with or assigns his salary for the benefit of his creditors; (d) If he absents himself from duty for a period of fourteen consecutive days except on leave .granted by the Minister (which leave is hereby authorised to be granted) or becomes incapable of performing his duties; (e) If he becomes in any way concerned or interested in any contract or agreement made by or on behalf of the Commissioner or in any wise participates or claims to be entitled to participate in the profit thereof or in any benefit or emolument arising therefrom. (8.) No. 9" exercise all the powers, functions, and authorities, and perform all the duties of the Commissioner, and shall be deemed to be the Commissioner. Case of ~ , : s: a. n: ~ ~ n (10.) In the case of suspension or death of the Com- missioner the Minister shall appoint some person who- shall, under the direction of the Minister, have and exercise all the powers, functions, and authorities, and perform all the duties of the Commissioner, and be deemed for the purposes of this Act to be the 'Commis- sioner until in the case of suspension the Commissioner has been restored to office, or until in the case of suspension and removal from office ~ fter suspension or death the Governor in Council has appointed a qualified. person to be Commissioner: . Provided, however, that an appointment made by the Minister under this subsection shall not be for a.. longer period than six months, but if necessity arises a.. further appointment of the same or another person may be made by the Minister for the like purpose for another period not exceeding six months. (2) All penalties and forfeitures which at the date aforesaid may be enforceable and recoverable by the said Main Roads Board' shall and may be enforced and recovered by the Commissioner. Past actions of Board. (3) All proceedings and things lawfully had and done by the said Main Roads Board shall be and continue to be in full force and effect t() . a.ll intents and purposes as if the same had

(4) All actions and proceedings pendi.ng on the Acts, &c. date aforesaid by or against the said Main Roads Board may be carried on and prosecuted by or against the Commissioner under this Act, and no such action or pro- ceeding shall abate or be discontinued or prejudicially affected by anything in this Act contained. (5) All regulations made under *" The ]}[ ain Roads Regulations Acts, 1920 to 1923," and in force at the date continued. aforesaid, shall continue in force until the same or any of them are amended or superseded by regulations under thjs Act, and in the constructjon of such regulations references to the expression " Main Roads Board" or " Board" shall be deemed to be references to the Commissioner, and references to the Chairman and Members of the Main Roads Board or Board or to the Chairman of the Main Roads Board or Board or any members or member of the Main Roads Board or Board shall be deemed to be references to the Commissioner, and references to any officer of the Board shall be deemed to be references to the employoe of the Commissioner author- ised or appointed in the like behali. (6) All instruments, documents, records, plans, Records. correspondence, and all books and writings the property of the said Main Roads Board shall be handed over to the Commissioner and become his property for the purposes of this Act. (7) All licenses, registrations, certificates, permits, ~ xisting authorities, and consents issued, made, hcenses, &0. granted, or given by the said Main Roads Board under or in pursuance of this Act or any regulation made thereunder and in force or sUbsisting on the said date shall continue in force for the period (if any) specified in such licenses, registrations, certificates, permits, * 10 Geo. General transfer power. authorities, or consents, unless the same are- sooner suspended, cancelled, or revoked under or in pursuance of this Act, and the same- shall be deemed to have been issued, made, granted, or given by the Commissioner, and a!J such documents shall be construed as if the Commissioner were therein named instead of the said Main Roads Board. (8) Notwithstanding the dissolution of the said Main Roads Board and the appointment ·of the Commissioner, the rights, powers, and authorities of the Treasurer under this Act shall, whether arising or accruing before or at or after the said date, continue in full force- and effect and shall not in any wiEe be prejudiced or affected by anything in this section contained. (9) Where in any Act other than this Act or in any regulation, proclamation, or Order in Council a reference is made to the Main Roads BO:1rd, such reference shall on and after the said date be deemed to be a reference to the Commissioner. (10) Without derogation from any of the foregoing p-:ovisions, all the powers, functions, or duties of the Commissioner cO!1.ferred and imposed under any other provisions, and all the functions, duties, rights, liabilities, privileges, and powers conferred and imposed upon the- saidM.ain Roads Board under this Act or any other Act shall, on and from the date afore- said, be vested in and be performed and exercised by the Commissioner. Corporation. [5.] The Commissioner, representing the Crown, shall be a corporation sole by the name of "The Commissioner of Main Roads," and by that name shall have perpeiu],l succession and an official seal, and shall be capable in law of suing and being sued. and shall .have power to take, purchase, sell, exchange, lease, and hold land, goods, chattels, and other property, and subject to this Act may do any acts not otherwise unlawful which may be necessary to the proper exercising and performance of the powers, functions, and duties of the Commissioner under this Act to the same extent as a private person may do.
1925. ROADS. Main Roads Acts Amendment Act. 11493 [6.] (1.) The Commissioner, with the approval of the Employees. Minister, shall appoint a Secretary and a Chief Engineer, and may with the like approval appoint and employ such administrative and technical employees and clerks and other employees to assist in the execution of this Act as may be necef'sary. The Secretary shall have power to execute documents on behalf of the Commissioner and affix the official seal thereto, and shall also have such other powers and perform such other duties as are from time to time appointed by the Commissioner. The Chief Engineer shall have such powers and perform such duties as are from time to time appointed by the Commissioner. The Co::nmissioner shall employ such employees and workmen as may be necessary for the carrying into execution of works under this Act or otherwise for carrying its provis:ons into full effect. Subject always to any award of the Court of Industrial Arbitration the Commissioner shall out of moneys from time to time appropriated by Parliament for the purpose pay such salaries, w8Jges, and allowances to his employees respectively as he thinks proper. No employee shall, without permission of the Commissioner, engage in any employment outside the duties of his engagement under this Act. Save as is provided in subsection two hereof, and unless in any case the Governor in Council otherwise directs, every employee shall hold office during pleasure only, and the Commissioner may dismiss any employee and may di.scontinue the offices of or appoint other persons in the place of employees who are dismissed or die or resign or otherwise vacate their employment. (2.) All officers and employees of the Main Roads Existing Board hereby dissolved (by whomsoever appointed) officers, &c. holding office or being employed at the date of the passing of" The Jl1 ain Roads A cts Amendment Act of 1925 " (other than workmen without specified period of employment) shall be deemed to have been appointed and employed as employees under this Act, but save as is next hereinafter expressly provided shall otherwise be. subject to be dealt with as employees of the ComI:nissioner.

No. 9, The Secretary of the said Main Roads Board holding office at the date of the passing of "The Main Roads Act Amendment Act of 1925" shall be the Secretary of the Commissioner without further appoint- ment. The services of any employees mentioned in this subsection may be terminated by the Commissioner, with the approval of the Minister. Power to delegate functions. [7.] The Commissioner, with the approval of the Minister, may from time to time delegate to some other employee all or any of the powers or duties of the Commissioner, and such delegation may be either for a specjfied time or without limit of time, and the Commis- sioner may, at any time, cancel such delegation. The employee to whom such powers or duties are delegated shall, to the extent of such delegation and while the same subsists, have all the powers and perform, all the duties of the Commissioner: but no such delegation shall be construed so as to prevent the Commissioner from also exercising any of such powers or performing any of such duties. Subject to the direction of the Governor in Council with respect to a decision of the Commissioner on matters of routine or of minor importance, no decision of the Commissioner shall have any effect unless or until it has ~ een confirmed by the Minister. Consequen. 5. In sections nine to thirty, both inclusive, and in tmiaelnatsm. end. sections 32, 33, 34, 39, 40, and 41 of the Principal Act, and in sections 7, 8, 14, 15, 21, 22, 24, and 27 of the Schedule of the Principal Act, the word "Board" wherever it occurs is repealed and the word "Commis- sioner" is inserted in lieu thereof. Amendment 6. The following provisions are added to section of s. 19. 19 of the Principal Act :-. "Any amounts appropriated by the ParHament of the Commonwealth of Australia for the construction of roads in this State, and in respect of which this State is the constructing authority, shall be paid into the Main Roads, Fund or Developmental Roads Fund or partly
ROADS. 114~ 15 1925. 1lfain Roads Acts Amendment Act. into each of such funds, as the Minister on the recom- mendation of the Commissioner thinks proper, and when so paid in shall be disbursed out of such fund or funds in like manner as other moneys in such funds are disbursed. The Commissioner shall from time to time prepare and furnish to the Minister recommendations for the allocation of such moneys and the :'.1inister may confirm or disallow or vary any such recommendations. The Commissioner may cause works to be carried out with such fund as are approved by the Minister, subject, if required, to the approval of the Government for the time being: ProVided that in cases where this State is required to subsidise the amount of any grant by the Commonwealth of Australia for the purposes aforesaid, the amount of such subsidy shall be granted in accordance with the p-::ovisions of this Act applicable to main roads or developmental roads, as the case may require. Notwithstanding the foregoing provjsjons, any moneys granted by the Commomvealth of Australia pursuant to the Act of the Parliament of the Common- wealth intituled rPhe JJf ain Roads Development Act 1923-1925 or [my Act amending or in substitution of the same may be expended by the Commissioner, with the approval of tho Minister and by agreement with the Local Authority concerned, upon ::my road, although the same is not a main road or developmental road under the provisions of this Act, and in such case the terms of repayment by the Local Authority concerned of its proportion of any such moneys as and by way of loan under this Act shall be determined by the Commissioner with the approval of the Minister before the commence- !,lent of any such work." 7. In the second paragraph of section twenty-one Amendment of the Principal Act, after the words "developmental of s. 21. roads " the words "and all moneys granted by the Government of thD Commomyealth of Australia for expenditure on developmental road projects" are inserted. 8. After paragraph (d) of section twenty-eight of-Amendment the Principal Act the following paragraph is inserted : _ of~ . 28. " (e) All moneys granted by the Government of the Commomvealth of Australia for the development of main roads ;" and paragraphs (e) and (f) of the said section are re- lettered (f) and (g) respectivaly. Section thirty-three of the Principal Act is <of s. 33. amended as follows :_ (a) The following paragraph is added to subsection one :-- . "Notwithstanding anything in this section, the Commissioner, with the approval of the Governor in Council, may relieve the Local Authority Ol' Local Authorities benefited of the part or of the whole of the prescribed contribution in respect to permanent works on main roads or developmental r01.ds passing through undeveloped country for the purpose of opening up communication if the Commissioner is satisfied that the payment of such contribution or such contributions in full would be unduly burdensome to the Local Authority or Local Authorities concerned. Before, however, taking action under this provision, the Commissioner shall take into consideration the revenue valuation and rating of each such Local Authority, and also its financial obligations in respect of loan expenditure under this Act or under any other Act with respect to loans to Local Authorities." (b) The following words are added to the first paragraph of subsection two :- "or when, in the opinion of the Commissioner, it appears advisable, owing to the cost of special necessary maintenance woek or bridge repairs or extensive repaving or surface protection of roads previously constructed, the Commissioner may, with the approval of the Governor in Council, allow such contributions to be repaid in equal annual repayments, not exceeding five. The Commissioner may relieve a Local Authority of part of or of the whole of the contribution due on account of expenditure on experimental road sections constructed for the purpose of determining the suitable- ness or otherwise of any particular class of road construction." (c) In the second paragraph of subsection five, all words from and including the word "Provided" to and including the words" benefited area," where those words secondly occur, are repealed, and the following provisions are inserted in lieu thereof:- "In any case where the Area of a Local Authority is divided into divisions, the Local Authority thereof may, by resolution in that behalf passed at a special

Main Roads Acts Amendment Act. meeting, from time to time decide that the repayments due on account of works constructed or maintained under this Act shall be payable by the ratepayers of the division or divisions in which the works were con- structed or mai.ntained, or if not so constructed or maintained therein, which has or have become bene- fited by such construction or maintenance, in which case a special rate so to be levied shall be a separate rate levied in and for such division or divisions: Provided that any such resolution may decide that the rate to be levied upon the ratepayers in such division or divisions shall not be equal, and in such case may prescribe a rate. in respect of the lands of some of such ratepayers and another rate or other rates in respect of the lands of others of such ratepayers in the division or divisions concerned. In case of any Area, whether divided into divisions or not so divided, the Local Authority may, by resolution in that behalf passed at a special meeting, from time to time recommend to the Minister that a benefited Area be declared, comprising any part of the Area; and the Minister may, if he thinks fit, disallow such recommendation or confirm such recommendation and declare a benefited Area in accordance with the terms thereof or vary such recommendation and declare a benefited Area in "accordance vrith the terms of such recommendation as so varied. In every case where a benefited Area has been declared by the Minister before the passing of "The Main Roads Acts Amendment Act of 1~ 25" under the provisions of this subsection before the amendment thereof by the .sa.id last-mentioned Act, and in every case where a cenefited Area is declared under the foregoing provisions after the passing of the said last- mentioned Act. such benefited Area shall remain a benefited Area in regard to the works in question, and also shall (unless or until varied by the Minister on the recommendation of the Local Authority, made as is hereinbefore provided) remain a benefited Area with respect to future works within the same bene- fited Area, and the special rate to be levied shall be a separate rate levied in and for such benefited Area: Provided that upon the recommendation of the Loca.l Authority the Minister may decide that the rate to be levied upon the ratepayers in such benefited Area. 11497

No. 9, 1925. shall not be equal, and in such case may prescribe a. rate in respect to the lands of some of such ratepayers and another rate or other rates in respect to the lands of others of such ratepayers. In any C8Jse where a benefited Area has been declared by the .Minister, 'whether before or after the passing of "The Jl1ain Roads Acts Amendment Act at 1925," the Minister may at any time and from time to time, as he thinks it expedient so to do, alter the boundaries of such benefited Area by excluding therefrom land theretofore included therein 0r by including therein land not theretofore so included. Every such alteration of boundaries shall be notified in the Gazette, and there- upon the benefited Area as so altered shall be the benefited Area for the purposes of this subsection in respeut of tLe works concerned. . If the Local Authority fails to hold a special meeting for the purpose of fixing or recommending the benefited Area w[-jch is to be charged with the amount of contri- bution due under this Act or fails to pass a resolution at any such special meeting for giving effect to the purpose for which the same was called, within ninety d( ~ys after the amount of contribution from such Local Authority has become a loan to it under the provisions of this subsection, then the 8Jmount of contribution shall be a charge agfJinst the wholo of the Area and payable accordingly. " (d) The following subsection is added to section thirty-three :- " (7.) For the purpose of ca,rrying' out additional maintenance work, the Commissioner may approve of the expenditure by the Local Authority from its own funds of amounts in excess of the amounts a.llocated by the Commissioner for expenditure on maintenance work: Provided that such additional maintenance work shall be carried out with the approval of the Commis- sioner and upon sections or at places approved by him." Amendment 10. The following amendments are made in the oSfchthedeule. Schedule of the Principal Act : - (a) The following provision is added to the first pa.ra.graph of section thirteen:- "Provided that while any such fees or rates aro prescribed to be paid, any by-laws of any Local Authority under which like fees or rates are made payable shall cease to have effect."
