AN ACT to authorise the payment of certain moneys to the Consolidated Revenue Fund instead of to the Main Roads Contribution Trust Account and the payment of certain moneys to the Main Roads Contribution Trust Account from the Main Roads Trust Account.

BE it enacted by the King's Most Excellent Majesty,by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows :—

This Act may be cited as the Main Roads Act (Funds Appropriation) Act (No. 2), 1941.

This Act shall be read in conjunction with the Main Roads Act, 1930-1939 (No. 5 of 1930 as amended by the Acts No. 2 of 1932, No. 3 of 1937, No. 4 of 1937, No. 29 of 1938, and No. 48 of 1939).

This Act shall operate and take effect and shall be deemed to have operated and to have had effect as from and including the first day of July one thousand nine hundred and forty-one.

In this Act, unless the context otherwise requires

"Federal Aid Roads Agreement" means the Federal Aid Roads Agreement as in force at the com- mencement of this Act under the Federal Aid Roads (New Agreement Authorisation) Act, 1936 (No. 33 of 1936), as amended by the Federal Aid Roads (New Agreement Authorisa- tion) Act Amendment Act, 1937 (No. 2 of 1937).

Main Roads (Funds Appropriation). [No. 34. "Main Roads Contribution Trust Account" means the Main Roads Contribution Trust Account established under section thirty-three of the principal Act.

"Main Roads Trust Account" means the Main Roads Trust Account established under section thirty of the principal Act.

"Principal Act" means the Main Roads Act, 1930-

the Consolidated Revenue Fund the moneys which he is authorised and required so to pay under section five of this Act, the Treasurer is hereby authorised to pay and, without any warrant of the Commissioner of Main Roads, shall pay into the Main Roads Contribution Trust Account for the purposes of section thirty-three of the principal Act, moneys of an amount equal to the amount of the moneys paid into the Consolidated Revenue Fund as aforesaid out of that portion of the moneys in the Main Roads Trust Account which consists of moneys received from the Commonwealth of Australia under and in accordance with the provisions of subclause (2) of clause two of the Federal Aid Roads Agreement.

This Act shall continue in operation for such period as shall be necessary to enable the payments authorised in sections five and six of this Act to be made in accordance with the authority conferred by the said sections, but shall not in any event continue in operation after the thirty-first day of December, one thousand nine hundred and forty-two.
