Main Roads Act Amendment Act 1985, No. 99 1537 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Main Roads Act Amendment Act 1985. (2) In this Act the Main Roads Act 1920-1984 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Main Roads Act 1920-1985. 2. Amendment of s. 38. Penalties for offences . Section 38 of the Principal Act is amended in subsection (3) by omitting the words "any fee" and substituting the words "an amount up to but not exceeding double the amount of any fee". 3. Amendment of s. 40 . Provisions as to Regulations . Section 40 of the Principal Act is amended by inserting after subsection (6A) the following subsection:- "(6B) The power to make regulations under subsection (6A) in respect of the notice referred to therein includes power to make regulations prescribing that the notice may, in addition to advising in relation to the prescribed penalty which may be paid, advise that an amount (determined by the Commissioner) up to but not exceeding double the amount of any fee or fees due for any purpose under this Act or the regulations thereunder, may be paid within the same period as that prescribed in respect of the prescribed penalty, without involving Court proceedings.". 4. Amendment of Schedule . Subject Matter for Regulations. The Schedule to the Principal Act is amended by omitting clause 32 and substituting the following clause:- "32. Number plates. (1) Providing for the regulation and control of official number plates for motor vehicles including prescribing- (a) the various types which may be issued, the methods of their preparation and the sizes, designs and colours applicable to each type; (b) the method of their issue, re-issue or transfer (including the number, size and type which may be issued) upon payment of such fees as may be prescribed or upon payment of an amount realised by the prescribed method of sale, tender or auction or by any other method prescribed; (c) that they shall remain the property of the Commissioner and prescribing the right or interest the person to whom they are issued has in the number plates; (d) the terms and conditions upon which they are issued and upon which they may be held, sold or otherwise
1538 Main Roads Act Amendment Act 1985, No. 99 disposed of, whether in conjunction with the sale of a motor vehicle or not and whether during the lifetime of the person entitled to possession of the number plates or after his death; (e) the circt mstances in which the Commissioner may recover them from the holder thereof. (2) Prescribing in respect of the carrying on motor vehicles of a coloured symbol denoting the currency of the registration of a motor vehicle. (3) Prohibiting the use of number plates other than those approved by the Commissioner and prohibiting the preparation of number plates other than with the approval of the Commissioner. (4) The power to make regulations under provision (1) . includes power to make regulations which have retrospective effect and validate acts or things done on and from a date not earlier than 1 March 1979.".
