1226 Main Roads Act Amendment Act 1984, No. 105 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Main Roads Act Amendment Act 1984. (2) In this Act the Main Roads Act 1920-1983 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Main Roads Act 1920-1984. 2. Amendment of s. 38. Penalties for offences . Section 38 of the Principal Act is amended in subsection (1) by omitting the words "of not exceeding $500" and substituting the words "not exceeding $1 000 ". 3. Amendment of s. 40. Provisions as to Regulations. Section 40 of the Principal Act is amended by- (a) in subsection (1)- (i) inserting after the first paragraph, the following paragraph:- " The regulations may also prescribe a penalty for a breach of any regulation so that such penalty is to be not less than a specified amount, is to be not more than a specified amount or is not to be modified or reduced."; (ii) omitting the expressions " $1000 " and " $500 " and substituting the expressions " $2 000 " and " $1000 " respectively; (b) inserting after subsection (6) the following subsection:- "(6A) The power to make regulations under this Act shall include power to make regulations prescribing- (a) any offences under this Act to be offences in respect of which a notice may be given or posted to an offender or affixed to a vehicle advising that a prescribed penalty may be paid for such offence within a prescribed period without involving Court proceedings; (b) the sums of money which shall be payable by way of penalties in respect of offences so prescribed which sums of money may be so prescribed differently in relation to different offences or differently in relation to any such offence according to previous like offences or the time, place or circumstance related to the commission of the offence; (c) the form of and the particulars to be contained in the notice; and (d) the manner in which the notice may be given or posted to an offender or affixed to a vehicle.".
Main Roads Act Amendment Act 1984, No. 105 1227 4. Ratification of certain regulations . A regulation made under the Main Roads Act 1920 or that Act as amended befote the passing of the Main Roads Act Amendment Act 1984 shall not be questioned in any proceeding by reason that it prescribes a minimum penalty for a breach of that regulation or any other regulation made under that Act or that Act as amended.
