812 ANNO VICESIMO QUARTO ELIZABETHAE SECUNDAE REGINAE No. 75 of 1975 An Act to amend the Main Roads Act 1920-1972 in certain particulars [ASSENTED TO 12TH DECEMBER, 1975] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Main Roads Act Amendment Act 1975. (2) In this Act the Main Roads Act 1920-1972 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Main Roads Act 1920-1975. 2. Amendment of s. 38 . Section 38 of the Principal Act is amended by in subsection (1) omitting the words " one hundred pounds " and substituting the expression " $500 ". 3. Amendment of s. 40 . Section 40 of the Principal Act is amended by in subsection (1)- (a) omitting the first paragraph and substituting the following paragraph:- " The regulations may prescribe a penalty for a breach of any regulation and may prescribe increased or differing penalties for successive breaches of any regulation or of the regulations generally.
Main Roads Act Amendment Act 1975, No. 75 813 Save as is authorized by the next following paragraph, a penalty prescribed by the regulations shall not exceed- (a) $1 000, in the case of a breach of a regulation directed to protecting roads or preventing or limiting damage to roads by way of- (i) prohibiting or regulating traffic on roads; or (ii) regulating the weight of vehicles, the weight of loads on vehicles, the weight on any axle or axles or tyre or tyres of vehicles, which in any case may use roads or by any other way; (b) $500, in the case of a breach of a regulation other than one referred to in provision (a)."; (b) omitting from the second paragraph the words "A regulation may also impose a daily penalty for any breach thereof " and substituting the following words:- " The regulations may prescribe a daily penalty for a breach of any regulation "; (c) omitting from the second paragraph the words " But no such penalty shall exceed five pounds per day " and substituting the words "A daily penalty prescribed by the regulations shall not exceed $50 per day "
