AN ACT to amend the Main Roads Act, 1930.

this present Parliament assembled, and by the authority of

the same, as follows:—

1.    This Act may be cited as the Main Roads Act Amend- Short title.

vzent Act, 1932, and shall be read as one with the Main Roads Act, 1930 (No. 5 of 1930), hereinafter referred to as the principal Act.

2.    (1.) This Act shall have effect as from and corn- refagtorerta-

mencing on the first day of July, one thousand nine hundred and thirty-two, and shall continue in operation only during such time as the agreement set out in the schedule to the Federal Aid Roads Agreement Act, 1.926 (No. 7 of 1926), as varied. by the agreement set out in the schedule to the Federal Aid Roads Agreement Act, 1931 (No. 16 of 1931), shall remain in force and no longer.

(2.) Nothing in this Act shall in any way affect the liabilities and obligations of local authorities under the pro- visions of the principal Act existing and still unsatisfied or undischarged as on the thirtieth day of June, one thousand nine hundred and thirty-two; and notwithstanding anything to the contrary in this Act contained, such local authorities may still be required to satisfy such liabilities and to dis- charge such obligations under and in accordance with the provisions of the principal Act as if this Act had not been passed.

Amendment of

1.            3. Section thirty-one of the principal Act is amended, as

follows:—

(a) by deleting paragraph (b) from subsection one, and inserting in lieu thereof a paragraph, as fol- lows :-

(b) subject as aforesaid shall be used and ap- plied in such manner and proportions as the Gov- ernor, on the recommendation of the Commis- sioner, shall from time to time determine in and for the purpose of defraying the cost of and in, cidental to the provision, construction, mainten- ance, and supervision of roads, whether main or developmental roads under this Act or not, and of any other work executed and provided under this Act.

(b)	by deleting the proviso to subsection one;
(c)	by inserting a new subsection after subsection three, as follows :—

(4.) Any expenditure incurred by the Commis- sioner in or in connection with the provision, con- struction, maintenance, and supervision of roads other than main or developmental roads under this Act, or in connection with the maintenance of developmental roads not in accordance with sec- tion twenty-seven of this Act prior to the com- mencement of this subsection, and the payment of any such expenditure out of moneys in the Main Roads Trust Account, is or are hereby validated.

Amendment of 4. Section thirty-three of the principal Act is repealed,

5. 33.	and a section is inserted in lieu thereof, as follows:-
The Main Roads

Contribution	33. (1.) There shall be established at the Treasury
Trust Account

and application of	an account, to be called "The Main Roads Contribution
moneys therein.	Trust Account," into which shall be paid the moneys to be appropriated by the Treasurer as provided for in subsection two of this section.
(2.) The Treasurer shall appropriate each month and pay into the Main Roads Contribution Trust Account twenty-two and one-half per cent. of the net balance re- ferred to in paragraph (b) of subsection two of section thirteen of the Traffic Act, 1919-1931, to the purposes of

this Act; and the balance remaining after such appro- priation shall. be taken to be the net balance for the pur- pose of the provisions of that section.

(3.) The moneys paid into the Main Roads Contribu- tion Trust Account prior to the first day of July, one thousand nine hundred and thirty-two, shall, as to so much thereof as was so paid in prior to the first day of July, one thousand nine hundred and thirty-one, be used and applied in accordance with the provisions of this Act as they existed prior to the commencement of this section. The balance of the said moneys and the moneys paid into the Main Roads Contribution Trust Account under this section shall be used and applied in such manner and proportions as the Governor on the recommendation of the Commissioner shall from time to time determine, in and for the purpose of defraying the cost of and inci- dental to the improvement by the Commissioner of roads and bridges mentioned in paragraph (b) of subsection two of section thirteen of the Traffic Act, 1919-1931, and the cost of and incidental to the provision, construction, reconstruction, improvement, maintenance, and super- vision by the Commissioner of any other road or bridge within the metropolitan area as constituted and defined under the said Traffic Act, 1919-1931, and the regulations made thereunder.
