An Act to authorize the Granting of Leases in respect of certain Land in the City of Sunshine and for other Purposes connected with that Land.

Preamble

WHEREAS by an Order in Council of the 26th day of November, 1929[1], certain Crown land in the Parish of Cut-paw-paw, County of Bourke, was temporarily reserved as a Site for Recreation and Public Purposes:

AND WHEREAS the corporation of the City of Sunshine is the committee of management of the said land:

AND WHEREAS the said corporation is holding certain moneys paid to it under a policy of insurance with respect to buildings on the site used by the Rosamond Bowling Club which were destroyed by fire:

AND WHEREAS it is expedient to require the said corporation to make a grant out of its funds of $15 000 for the erection of a new club-house for use by the Rosamond Bowling Club and to authorize the said corporation, as committee of management of the said land, to grant leases of that part of the said land delineated and shown hatched on the plan in the Schedule and to make other provision as hereinafter enacted:

BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1.Short title and commencement

(1)This Act may be cited as the Maidstone Land Act 1973.

(2)This Act shall come into operation on the day it receives the Royal Assent.

2.Definition

In this Act "corporation" means the corporation of the City of Sunshine.

3.Corporation to make grant of $15 000

The corporation shall make a grant of $15 000 out of its municipal fund to be paid for or towards the cost of erecting improvements by way of a club-house on the land delineated and shown hatched on the plan in the Schedule and for so doing the provisions of this section shall be sufficient authority.

4.Power to grant leases etc. of land

(1)Notwithstanding anything to the contrary in any Act the corporation, as committee of management, may from time to time grant leases of the whole or any part of the land delineated and shown hatched on the plan in the Schedule for the purposes of a bowling green and amenities connected therewith including the erection of buildings.

(2)A lease granted under this section—

(a)shall be subject to such covenants, conditions, exceptions, and reservations as the corporation thinks fit;

(b)shall be for a term not exceeding 21 years; and

(c)shall be subject to approval by the Governor in Council.

(3)The moneys received by way of rent under any lease granted under this section shall be applied by the corporation towards the maintenance and improvement of any part of the land temporarily reserved by the Order in Council of the 26th day of November, 1929, not leased under this section or for any other purpose approved by the Minister.

(4)No compensation shall be payable by the Crown in respect of any act matter or thing done under or arising out of this section.

Land in the Parish of Cut-paw-paw in respect of which the corporation of the City of Sunshine may grant leases for the purposes of a bowling green and amenities connected therewith, including the erection of buildings.
