Magistrates Court (Monetary Limits) Amendment Act 2016

An Act to amend the Magistrates Court Act 1991.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Magistrates Court (Monetary Limits) Amendment Act 2016.

2Commencement

This Act will come into operation on a day to be fixed by proclamation.

3Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Magistrates Court Act 19914Amendment of section 3 – Interpretation
  1. (1)

    Section 3(1), definition of minor statutory proceeding, (ba)—delete "$25 000" and substitute:

    $12 000

  2. (2)

    Section 3(1), definition of small claim—delete "$25 000" and substitute:

    $12 000

  3. (3)

    Section 3(4)(a) and (b)—delete "$25 000" wherever occurring and substitute in each case:

    $12 000

Schedule 1—Transitional provision

1—Transitional provision

The amendments made to section 3 of the Magistrates Court Act 1991 by this Act—

  1. (a)

    do not apply in respect of proceedings commenced before the commencement of this Act (and those proceedings may continue as if this Act had not been enacted); and

  2. (b)

    apply in respect of proceedings commenced on or after the commencement of this Act (including proceedings in respect of a claim arising before the commencement of this Act).
