Magistrates' Court Act 1989

Magistrates' Court (Judicial Registrars) Further Amendment Rules 2021

The Chief Magistrate together with 2 Deputy Chief Magistrates jointly make the following Rules:

1Object

The object of these Rules is to prescribe proceedings under the Road Safety Act 1986, the Domestic Animals Act 1994 and the North East Link Act 2020 which may be dealt with by the Court constituted by a judicial registrar.

2Authorising provisions

These Rules are made under sections 16 and 16I of the Magistrates' Court Act 1989 and all other enabling powers.

3Commencement

These Rules come into operation on 15 December 2021.

4Criminal proceedings and related proceedings that may be dealt with by judicial registrars

(1)In Rule 6 of the Magistrates' Court (Judicial Registrars) Rules 2015[1], after "Court" insert ", except the powers set out in section 16I(b) of the Act,".

(2)Rule 6(eab), (eac), (eb) and (f) of the Magistrates' Court (Judicial Registrars) Rules 2015 are revoked.

(3)In Rule 6(g) of the Magistrates' Court (Judicial Registrars) Rules 2015, for "regulation 20(1) of the Corrections Regulations 2009." substitute "regulation 23(1) of the Corrections Regulations 2019;".

(4)After Rule 6(g) of the Magistrates' Court (Judicial Registrars) Rules 2015 insert—

"(h)a proceeding under a provision specified in an item of column 2 of Schedule 1.".

5Powers of judicial registrars in certain criminal proceedings and certain related proceedings

For Rule 7(4) of the Magistrates' Court (Judicial Registrars) Rules 2015 substitute—

"(4)A judicial registrar may exercise all or any of the powers of the Court under section 61B of the Marine (Drug, Alcohol and Pollution Control) Act 1988.".

6New Schedule 1 inserted

At the end of the Magistrates' Court (Judicial Registrars) Rules 2015 insert the following Schedule—
