Magistrates Court (General) Amendment
Rules 2018
Made by the Magistrates Court.
1. Citation
These rules are the Magistrates Court (General) Amendment
Rules 2018.
2. Commencement
These rules come into operation as follows —
(a)
rules 1 and 2— on the day on which these rules are published in the Gazette;
(b) the rest of the rules — on the day after that day.
3. Rules amended These rules amend the Magistrates Court (General) Rules 2005.
4. Rule 40 amended
relation to the charge.
(1) Delete rule 40(1) and insert:
(1) Except as provided in any order under the Criminal Procedure Act 2004 section 171, in respect of criminal proceedings in the Court, any person is entitled, on
request, to the following information relating to a
particular case —
(a) the name of the accused; (b) in relation to each charge in that case against the accused — (i) the charge; and
(ii) any conviction or order made in respect of the charge; and
(iii) any penalty imposed on the accused in

(2) After rule 40(2) insert:
(3) Nothing in subrule (I) entitles a person to obtain
information about the accused's criminal history other
than information in respect of a charge in the case to
