Regulations 1999

The Governor in Council makes the following Regulations:

1. Objectives

The objectives of these Regulations are to prescribe certain further provisions under which infringement notices may be issued in order that the enforcement procedure under Schedule 7 to the Act may be used, to make a minor amendment to a Form and to make certain statute law revision amendments.

2. Authorising provision

These Regulations are made under section 140(1) of the Magistrates' Court Act 1989.

3. Commencement

These Regulations come into operation on
20 December 1999.

4. Principal Regulations

In these Regulations, the Magistrates' Court
General Regulations 19901 are called the Principal
Regulations.

5.  Further provisions under which infringement notices may be issued

In regulation 1103 of the Principal Regulations—

(a)

after paragraph (ab) insert— "(ac) sections 23, 25, 26(1) and 36(2) of the

Domestic Building Contracts Act

1995;";

(b)

after paragraph (d) insert— "(da) sections 29(1), 35, 36(2), 36(4), 38(1)

and 38(2) of the Introduction Agents

Act 1998;"

(c)

after paragraph (fc) insert— "(fd) sections 20(1), 25(2), 27(3), 31B(1),

34, 35(2), 41(2)(b), 42(2)(a), 42(2)(b),
42A(1), 44, 52(1) and 52(6) of the
Motor Car Traders Act 1986 and
regulations 23(1), 24(1) and 24(2) of
the Motor Car Trader Regulations

1998;".

6. Amendment of Form 2 of Schedule 5

In Schedule 5 to the Principal Regulations, in

Form 2—

(a)

for "magnetic tape" substitute "*magnetic disc/*microdisc";

(b)

at the foot of the Form insert "*delete if not applicable".

7. Statute Law Revision

(1) In regulation 601 of the Principal Regulations, in

paragraph (a), for "Firearms and Other
Weapons Act 1958" substitute "Firearms Act
1996".

(2) In regulation 802 of the Principal Regulations for "Firearms Act 1958" substitute "Firearms Act 1996".
