Magistrates' Court Act 1989
Magistrates' Court (Criminal Procedure) (Infringements Court Venue) Rules 2007
The Chief Magistrate together with 2 Deputy Chief Magistrates jointly make the following Rules:
1Object
The object of these Rules is to—
(a)revoke the Magistrates' Court (Criminal Procedure) (Infringements Court) Rules 2007; and
(b)remake those Rules so that the amendments set out in them to the Magistrates' Court (Criminal Procedure) Rules 2006 will not come into operation until 2 July 2007.
2Authorising provisions
These Rules are made under section 16 of the Magistrates' Court Act 1989 and all other enabling powers.
3Commencement
(1)These Rules (except Rules 5 and 6) come into operation on 11 June 2007.
(2)Rules 5 and 6 come into operation on 2 July 2007.
4Revocation
The Magistrates' Court (Criminal Procedure) (Infringements Court) Rules 2007[1] are revoked.
5Amendment to object
In Rule 1.01 of the Magistrates' Court (Criminal Procedure) Rules 2006[2], for paragraph (b), substitute—
"(b)prescribe a venue of the Court for the purposes of the Infringements Act 2006; and".
6Venue of Infringements Court
In Rule 3.01 of the Magistrates' Court (Criminal Procedure) Rules 2006, for "436 Lonsdale Street Melbourne." substitute "444 Swanston Street Carlton.".
