Magistrates' Court Act 1989
Magistrates' Court Criminal Procedure Amendment (Open Courts) Rules 2020
The Chief Magistrate together with 2 Deputy Chief Magistrates jointly make the following Rules:
1Object
The object of these Rules is to make amendments to the Magistrates' Court Criminal Procedure Rules 2019 as a consequence of amendments made to the Open Courts Act 2013 by the Open Courts and Other Acts Amendment Act 2019.
2Authorising provisions
These Rules are made under section 16 of the Magistrates' Court Act 1989 and all other enabling powers.
3Commencement
These Rules come into operation on 1 June 2020.
4Form 54 amended
In Form 54 of the Magistrates' Court Criminal Procedure Rules 2019[1], for "APPLICATION FOR SUPPRESSION ORDER" substitute—
"APPLICATION FOR SUPPRESSION ORDER
(Section 10 of the Open Courts Act 2013)".
5Form 55 amended
(1)In Form 55 of the Magistrates' Court Criminal Procedure Rules 2019, for "APPLICATION TO REVIEW A SUPPRESSION ORDER" substitute—
"APPLICATION TO REVIEW A SUPPRESSION ORDER
(Section 15 of the Open Courts Act 2013)".
(2)In Form 55 of the Magistrates' Court Criminal Procedure Rules 2019, for—
"o A party to the proceeding"
substitute—
"o A party to the proceeding
oA victim or an alleged victim of a *sexual offence/*family violence offence".
