Magistrates' Court Civil Procedure (Amendment

No. 3) Rules 2000

The Chief Magistrate together with 2 Deputy Chief

Magistrates jointly make the following Rules:

1. Object

The object of these Rules is to clarify, for the
avoidance of any doubt, the power of a registrar to
refer a complaint to a registrar or a magistrate for

a pre-hearing conference.

2. Authorising provision

These Rules are made under section 16 of the enabling powers.

3. Principal Rules

In these Rules, the Magistrates' Court Civil
Procedure Rules 19991 are called the Principal

Rules.

4. New Rule 22.00 inserted

After the heading to Order 22 of the Principal

Rules insert—

"22.00 Referral of complaint for pre-hearing

conference

For the purposes of section 107(1) of the

Act, the Court constituted by—

(a) a magistrate; or

Magistrates' Court Civil Procedure (Amendment No. 3) Rules
2000

r. 4 S.R. No. 22/2000

(b) a registrar—

may order that a complaint be referred to a
magistrate or a registrar for a pre-hearing

conference.".
