Magistrates' Court Act 1989

Magistrates' Court Civil Procedure (Amendment No. 21) Rules 2007

The Chief Magistrate together with 2 Deputy Chief Magistrates jointly make the following Rules:

1Object

The object of these Rules is to amend the Magistrates' Court Civil Procedure Rules 1999 to make further provision for costs payable in matters and proceedings before the Court.

2Authorising provisions

These Rules are made under section 16 of the Magistrates' Court Act 1989 and all other enabling powers.

3Commencement

These Rules come into operation on 1 January 2008.

4Principal Rules

In these Rules, the Magistrates' Court Civil Procedure Rules 1999[1] are called the Principal Rules.

5Amendments to Appendix A

(1)In item 1 of the Scale of Costs in Appendix A to the Principal Rules—

(a)in paragraph (a), for "153" substitute "158";

(b)in paragraph (b), for "320" substitute "331";

(c)in paragraph (c), for "393" substitute "406";

(d)in paragraph (d), for "470" substitute "486";

(e)in paragraph (e), for "585" substitute "605";

(f)in paragraph (f), for "704" substitute "728";

(g)in paragraph (g), for "842" substitute "870".

(2)For item 60 of the Scale of Costs in Appendix A to the Principal Rules substitute—

"60.Copies—

For the first 50 pages of photocopying in a proceeding, $2.00 per page.

For any photocopying after the first 50 pages in a proceeding, 60 cents per page.".

(3)In item 82 of the Scale of Costs in Appendix A to the Principal Rules—
