Magistrates Court Amendment

Regulations 2011

Made by the Lieutenant-Governor and Administrator in Executive
Council.

1.            Citation

These regulations are the Magistrates Court Amendment
Regulations 2011.
(I) A metropolitan

2.            Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on the day after that day.

3.            Regulations amended

These regulations amend the Magistrates Court
Regulations 2005.

4.            Regulation 5 amended

(1) In regulation 5 delete "A metropolitan" and insert:

(2) At the end of regulation 5 insert:

(2) A metropolitan court constituted by 2 JPs alone may adjourn the following for hearing by the Magistrates Court constituted by a magistrate -

(a)

an application made under the Prohibited Behaviour Orders Act 2010 section 5 for a PBO;

(b)

an application made under the Prohibited Behaviour Orders Act 2010 section 21 to vary or cancel a PBO.

(3) A metropolitan court constituted by 2 JPs alone must subregulation (2).

5.            Regulation 9 amended

(1) In regulation 9 delete "A country" and insert:
