Magistrates and Coroner’s Courts (Registrar) Act 1991

An Act to alter the names of the offices of Clerk of the Magistrates Court and Clerk of the Coroner’s Court to Registrar of the Magistrates Court and Registrar of the Coroner’s Court and for related purposes

The Legislative Assembly for the Australian Capital Territory enacts as follows:
part i—preliminary
Short title
1. This Act may be cited as the Magistrates and Coroner’s Courts (Registrar) Act 1991.
Commencement
2. (1) Section 1 and this section commence on the day on which this Act is notified in the Gazette.
(2) The remaining provisions commence on a day, or respective days, fixed by the Minister by notice in the Gazette.
(3) If a provision referred to in subsection (2) has not commenced before the end of the period of 6 months commencing on the day on which this Act is notified in the Gazette, that provision, by force of this subsection, commences on the first day after the end of that period.
part ii—clerk of the magistrates court
Alteration of names
3. (1) The name of the office of Clerk of the Magistrates Court is altered to Registrar of the Magistrates Court.
(2) The name of the office of Deputy Clerk of the Magistrates Court is altered to Deputy Registrar of the Magistrates Court.
Continuance in office
4. A person who held office immediately before the commencement of this Act as Clerk or Deputy Clerk of the Magistrates Court shall continue to hold office as Registrar or Deputy Registrar of the Magistrates Court.
part iii—clerk of the coroner’s court
Alteration of names
5. (1) The name of the office of Clerk of the Coroner’s Court is altered to Registrar of the Coroner’s Court.
(2) The name of the office of Deputy Clerk of the Coroner’s Court is altered to Deputy Registrar of the Coroner’s Court.
Continuance in office
6. A person who held office immediately before the commencement of this Act as Clerk or Deputy Clerk of the Coroner’s Court shall continue to hold office as Registrar or Deputy Registrar of the Coroner’s Court.
part iv—consequential amendments
Amendment of Acts
7. (1) The Magistrates Court Act 1930 is amended—
(a)by omitting from subsection 5 (1) the definition of “Registrar”; and
(b)by omitting from Form 4 in The First Schedule “Registrar” and substituting “Registrar of the Supreme Court”.
(2) The provisions of the Acts specified in Schedule 1 are amended—
(a)by omitting “clerk” and “Clerk” (wherever occurring) and substituting “Registrar”; and
(b)by omitting “Clerk”, “Clerk”, “Clerks” and “CLERK’S” (wherever occurring) and substituting “Registrar”, “Registrar”, “Registrars” and “REGISTRAR’S” (respectively).
Amendment of regulations and rules
8. The provisions of the regulations and rules specified in Schedule 2 are amended by omitting “clerk” and “Clerk” (wherever occurring) and substituting “Registrar”.
Amendment of continued State laws
9. The provisions of the following laws are amended by omitting “Clerk” (wherever occurring) and substituting “Registrar”:
(a)the Crimes Act, 1900 of the State of New South Wales in its application in the Territory;
(b)the Pawnbrokers Act 1902 of the State of New South Wales in its application in the Territory;
(c)the Second-hand Dealers and Collectors Act 1906 of the State of New South Wales in its application in the Territory.
