The Australian Fisheries Management Authority makes the following determination in accordance with a decision made by the Commission under section 25 of the Fisheries Administration Act 1991.

1  Name

This instrument is the Macquarie Island Toothfish Fishery (Total Allowable Catch) Determination No.2 2020.

2  Commencement

This instrument commences the day after it is registered on the Federal Register of Legislation.

3  Authority

This instrument is made pursuant to paragraph 17(6)(aa) of the Fisheries Management Act 1991 under section 11 of the Macquarie Island Toothfish Fishery Management Plan 2006.

4  Cessation

This instrument ceases as if it was revoked on 4 April 2022 unless earlier revoked.

5   Definitions

A term used in this instrument that is defined for the purposes of the Macquarie Island Toothfish Fishery Management Plan 2006  (the Plan) has the same meaning in this instrument as it has in the Plan.

Note:          Terms defined in the Fisheries Management Act 1991 have the same meanings in this instrument. 

1. Schedules    

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

7  Determination of total allowable catch

(1)The total allowable catch for Patagonian toothfish and catch limits for other species in the Macquarie Island Toothfish Fishery for the 2020/2021 fishing year, commencing on 4 April 2020 and ending on 3 April 2021, and the 2021/22 fishing year, commencing on 4 April 2021 and ending on 3 April 2022 are:

(a)555 tonnes for each fishing year for Patagonian toothfish (Dissostichus eleginoides); and

(b)50 tonnes for each fishing year for singular catch limit for each of the other species in the Macquarie Island Toothfish Fishery.
